  Blockbuster Working on Set-Top Box

  An anonymous reader writes "According to the Hollywood Reporter and news.com, Blockbuster will soon be announcing yet another reason not to go to a rental store. A media-delivering set-top box is in the works for the company, leveraging the store's existing competence in the industry to provide a viable alternative to iTunes, Xbox Live, and Amazon. 'There was no mention of price or how such a service would work in the report. But let's think about this: to compete with Apple TV or Vudu, the device would have to cost around $200, and rentals of movies and TV shows should be around $3 to $4 each, which would be slightly cheaper than rentals of new releases from Blockbuster currently. The big advantage Blockbuster would enjoy over Apple TV, Vudu, and TiVo, it seems, would be selection.'" I still think they're kinda doomed.

  Psychologists Don't Know Math

  stupefaction writes "The New York Times reports that an economist has exposed a mathematical fallacy at the heart of the experimental backing for the psychological theory of cognitive dissonance. The mistake is the same one that mathematicians both amateur and professional have made over the Monty Hall problem. From the article: "Like Monty Hall's choice of which door to open to reveal a goat, the monkey's choice of red over blue discloses information that changes the odds." The reporter John Tierney invites readers to comment on the goats-and-car paradox as well as on three other probabilistic brain-teasers."

  Smallest Planet Outside Our Solar System Found

  mikkl666 writes "Following the recent story about the discovery of the youngest planet outside our solar system, Spanish researchers now report that they found the smallest exoplanet observed so far. The planet, known as GJ 436c, was found by analyzing distortions in the orbit of another, larger planet, and its radius is only about 50 percent greater than the Earth's. The scientists are confident that their new method will lead to a series of further discoveries: 'I think we are very close, just a few years away, from detecting a planet like Earth.'   Top Botnets Control Some 1 Million Hijacked Computers

  Puskas writes "Joe Stewart is the director of malware research at SecureWorks, and presented a dire view of the current botnet landscape at the RSA conference this week. He conducted a survey of the top spamming 'nets, extrapolating their size from the volume of emails that flow across the internet. By his calculations, the top 11 networks control just over a million machines, hitting inboxes with some 100 billion messages a day. 'The botnet at the top of the chart is Srizbi. According to Stewart, this botnet — which also goes by the names "Cbeplay" and "Exchanger" — has an estimated 315,000 bots and can blast out 60 billion messages a day. While it may not have gotten the publicity that Storm has during the last year, it's built around a much more substantial collection of hijacked computers, said Stewart. In comparison, Storm's botnet counts just 85,000 machines, only 35,000 of which are set up to send spam. Storm, in fact, is No. 5 on Stewart's list.'"

  AOL Jumps Into the Ring with Microsoft, Yahoo!, Google

  mikkl666 writes "Even just since this morning, there's much to report in the ongoing fight between Microsoft and Yahoo!. After Yahoo! announced yesterday that they are testing Google AdSense, Microsoft reacted with a comment pointing out that 'any definitive agreement between Yahoo! and Google would consolidate over 90% of the search advertising market in Google's hands.' Ironically, they complain that 'this would make the market far less competitive.' Both companies try to team up with strong partners, as well. Yahoo! and AOL are now closing in on a deal to combine their Internet operations. And of course, this morning's news was that Rupert Murdoch's News Corp. is apparently in talks for a joint bid for Yahoo!"

  Asus Crams Three GPUs onto a Single Graphics Card

  Barence writes "PC Pro has up a look at Asus' concept triple-GPU graphics card. It's a tech demo, so it's not going to see release at any point in the future, but it's an interesting look at how far manufacturers can push technology, as well as just how inefficient multi-GPU graphics cards currently are. 'Asus has spaced [the GPUs] out, placing one on the top of the card and two on the underside. This creates its own problem, though: attaching heatsinks and fans to both sides of the card would prevent it from fitting into some case arrangements, and defeat access to neighbouring expansion slots. So instead, Asus has used a low-profile heat-pipe system that channels the heat to a heatsink at the back of the card, from where it's dissipated by externally-powered fluid cooling pipes.'"

  GPS Trackers Find Novel Applications

  Pickens writes "Inexpensive GPS devices like the Zoombak (which costs just $200 plus $10 a month) have becomes so prevalent that some people are using them routinely to keep tabs on their most precious possessions. Kathy Besa has a Zoombak attached to the collar of her 5-year-old beagle, Buddy. If Buddy wanders more than 20 feet from the house, she gets a text message on her phone that says, 'Buddy has left the premises.' The small size made possible by chip advances over the last two or three years is enabling many novel uses of GPS tracking. An art collector in New York uses one when he transports million-dollar pieces, a home builder is putting them on expensive appliances to track them if they disappear from construction sites, a drug company is using them after millions of dollars in inventory turned up missing, and a mobile phone company is hiding them in some cellphone boxes to catch thieves."

  Charlton Heston's Impact On Sci-Fi

  An anonymous reader writes "As you're probably already aware, Charlton Heston passed away yesterday. Wired has a piece looking back at Heston's extremely notable work in the sci-fi genre, with roles in films like "Planet of the Apes" and "Soylent Green". 'Heston also roared out some of sci-fi's greatest and most memorable lines, bringing his macho swagger and over-the-top intensity to the screen in movies like 1973's food freak-out flick Soylent Green and the Planet of the Apes series. In a pivotal scene from 1968's Planet of the Apes (see clip), Heston's character, time-traveling astronaut George Taylor, utters the first words spoken by a human to the simian rulers of a bizarro future Earth: "Take your stinking paws off me, you damn dirty ape!'"

According to the site, Blizzard has learned eleven lessons on innovation that can help almost any business. The industry leader used these innovation methods not only to create the world's most popular massively multiplayer online game, World of Warcraft, but also to keep the game fresh and challenging for more than 10 million players. Because many of those customers pay $15 a month to continue playing, Blizzard's ongoing creative achievement is worth more than $1 billion a year in revenues, not counting the multi-millions it tallies from its other games."

  VR Study Says 40% of Us Are Paranoid

  Roland Piquepaille writes "UK researchers have recently used virtual reality to check if people had paranoid thoughts when using public transportation. Their VR tube ride experiment revealed that 40% of the participants experienced exaggerated fears about threats from others. Until now, researchers were relying on somewhat unreliable questionnaires to study paranoid thoughts which are often triggered by ambiguous events such as someone laughing behind their back. With the use of VR, psychiatrists and psychologists have a new tool which can reliably recreate social interactions. As the lead researcher said, VR 'is a uniquely powerful method to detect those liable to misinterpret other people.'."

  College Board Kills AP Computer Science AB

  jhealy1024 writes "The College Board recently announced it will be getting rid of the Advanced Placement Computer Science AB examination after May 2009. The 'A'-level exam will continue to be offered, though there is no word yet on what will become of the AB-level material (e.g., if it will be merged into A or just dropped). Many teachers of AP CS are upset about the move, as it seems the decision was made without consulting members of the CS teaching community. As one teacher put it: 'this is like telling the football coach next year is the last year you have a varsity team.'"

  China Allows Access to English Wikipedia

  LinuxLefty writes "Reuters is reporting that Chinese authorities have lifted the ban on the English version of Wikipedia. The Chinese version of the site is still blocked, as are English-language versions of politically sensitive topics such as Tibet and Tiananmen Square. 'The move comes after International Olympic Committee (IOC) inspectors told Beijing organisers that the Internet must be open for the duration of the 2008 Olympics and that blocking it "would reflect very poorly" on the host country. China's government, keen to avoid sparking social discontent, keeps a tight watch over the media and often blocks or censors popular Web sites and forums where dissent may brew.'"

  UK Banking Law Blames Customers For Insecure OS

  twitter writes "If you use an insecure OS in the UK and someone drains your bank account, the banks say it's your fault. The Register reports: 'The Banking Code produced by the British Bankers' Association (BBA), and followed by most banks, makes it clear that banks will not be responsible for losses on online bank accounts if consumers do not have up to date anti-virus, anti-spyware, and firewall software installed on their machines.'" twitter went on to note that the majority of consumer PCs use an operating system with a history of security issues. Should end users be ultimately responsible for the state of their systems?

  Former Crypto-Analyst Analyzes the Danger of Nuclear Weapon Stockpiles

  An anonymous reader writes "IEEE Spectrum reports that noted encryption pioneer Prof. Martin Hellman has a new passion; estimating the risk of our current nuclear weapons policies. His web site, Defusing the Nuclear Threat, asks the question, 'How risky are nuclear weapons? Amazingly, no one seems to know.' Hellman therefore did a preliminary analysis and found the risk to be 'equivalent to having your home surrounded by thousands of nuclear power plants.' The web site and a related statement therefore urgently call for more detailed studies to either confirm or correct his startling conclusion. The statement has been signed by seven notable individuals including former NSA Director Adm. Bobby R. Inman and two Nobel Laureates."

  Unique Broadband Over Powerline Project Planned For Mosques

  Lucas123 writes "Broadband over powerline (BPL) provider Velchip is heading up a project that will offer 60 million very unique network users an unlimited high speed Internet connection of 224Mbps at a cost of only around RM5 ($1.58) per user per month. That's the cheapest, fastest internet connection in the world. The network is slated for use in the $14 billion 'Smart Mosque' project, which will be rolled out over three years in Indonesia and will link together 400,000 mosques. To add some perspective, in the US Verizon FiOS currently offers up to 30 Mbps downloads and 5 Mbps uploads starting at $42.99 a month. BPL modems use existing electrical power lines to deliver high speed Internet access and data transmission."

  Venus' Stop/Start History Highlighted By Probe

  An anonymous reader writes "Science Daily reports on scientific findings from the ESA's Venus Express probe. The device, which is even now orbiting Earth's sister planet, is feeding back data hinting at Venus' origins. Initially, the probe has found, the planet evolved far too quickly. As a result Venus' liquid oceans were boiled away. With those gone, the planet's development stalled and ceased. 'They may have started out looking very much the same,' said Professor Taylor, 'but increasingly we have evidence that Venus lost most of its water and Earth lost most of its atmospheric carbon dioxide ... The interesting thing is that the physics is the same in both cases. The great achievement of Venus Express is that it is putting the climatic behaviour of both planets into a common framework of understanding.'"

  Are Optional Ads Worth The Trouble?

  azuredrake writes "NCSoft's City of Heroes has just announced that in-game ads are being added to the game, provided by an advertising firm Double Fusion. However, unlike in many games, the ads being brought to CoH have been defined as 'always optional'. The publishers see the ads as a purely additional revenue stream, not as something that will ever allow advertisers to affect game content. Commentary is available at Gamasutra. Is making advertisement volunteer-based a viable way to get around cynicism? The tone of these ads seems to be 'check them out to help the game'. Are there any sites or services in which you'd voluntarily look at ads to lend a hand? "

  Europe's Automated Cargo Shuttle Docks With Space Station

  An anonymous reader writes "A successful docking of the Automated Transfer Vehicle dubbed 'Jules Verne' occurred earlier this week. The first of its kind, the crewless ship reached orbit and lightly touched up against the international space station on Thursday. By now astronauts on the ISS will have opened its doors and begun air circulation in preparation of offloading the nearly 7.5 tons of fuel, oxygen, food, clothing and equipment they need to survive. The EU Space Agency sees this as a historic journey for the program: 'The Jules Verne, named after the visionary French science fiction author, is the first of a new class of station supply ships called Automatic Transfer Vehicles. The craft was built by the nations of the European Space Agency as one of Europe's major contributions to the international station. "The docking of the A.T.V. is a new and spectacular step in the demonstration of European capabilities on the international scene of space exploration," said Jean-Jacques Dordain, director general of the European Space Agency.'"

  Matrix-Like VR Coming in the Near Future?

  Anonymongoose writes "A researcher at Brookhaven National Lab reckons it could be just a few years before computers can pass through the uncanny valley. The article refers to this as a 'Graphics Turing Test': 'a computer can be considered intelligent if it can create an artificial world capable of fooling a person into believing it is the real thing.' Michael McGuigan has been performing some interesting experiments using Brookhaven's Blue Gene/L supercomputer and has shown that it can produce realistic lighting effects in real time. McGuigan's original research paper (pdf) is available online."

  Having Your ID Stolen Leads to Job Loss, Prosecution

  ConfusedVorlon writes "The BBC reports on the sad case of Simon Bunce. Mr. Bunce had his identity stolen, and credit cards were made to capitalize on the theft. Some of those cards were used at sites offering child pornography, and as a result Mr. Bunce was swept up in Operation Ore. The poor man was prosecuted for his 'crime', and was eventually found innocent, but in the meantime he lost his job. It took him six months to find another at a quarter of the salary. 'The police's computer technicians take several months to examine [his computers and records], and Mr Bunce could not afford to wait to repair the damage done to his reputation. "I knew there'd been a fundamental mistake made and so I had to investigate it." Recent surveys suggest that as many as one in four Britons have been affected by it. In 2007 more than 185,000 cases of identity theft were identified by Cifas, the UK's fraud prevention service, an increase of almost 8% on 2006.'"

  Boot Sector Viruses & Rootkits Poised For Comeback

  Ant writes "Ars Technica says Panda Labs' first quarter 2008 malware report raises a new concern, though it comes from a surprising direction. According to the company, boot sector viruses loaded with rootkits are poised to make a comeback. This honestly sounds a bit odd, considering how long it has been since a boot virus has topped the malware charts, but it's at least theoretically possible (pdf). Such viruses have a simple method of operation. The virus copies itself into the Master Boot Record (MBR) of a hard drive, and rewrites the actual MBR data in a different section of the drive. The report also covers a number of other topics and makes predictions about the types of attacks computer users may see in the future. Forecasting these trends is always tricky."

  Engineers Make Good Terrorists?

  An anonymous reader writes "Engineers' focus and attention to details, along with their perceived lack of social skills, make them ideal targets to be recruited as terrorists, according to EETimes. Planning skills make engineers good 'field operatives' was written up by Raphael Perl, who heads the Action against Terrorism Unit of Organization for Security and Cooperation in Europe. He offers that 'Engineers ideally make excellent strategic planners, and they make excellent field operatives. They think differently from how other people think.' That may sound like a stereotype, but Perl claims that 'because of those traits, terrorist groups actively recruit engineers.' He says that Al-Qaeda has widely acknowledged that a significant number of the group's top leadership had engineering backgrounds." This the second time in just a few months that engineers have been likened to terrorists.

  Inside Intel's $20M Multicore Research Program

  An anonymous reader writes "You may have heard about Intel's and Microsoft's efforts to finally get multi-core programming into gear so that there actually will be a developer who can program all those fancy new multicore processors, which may have dozens of core on one chip within a few years. TG Daily has an interesting article about the project, written by one of the researchers. It looks like there is a lot of excitement around the opportunity to create a new generation of development tools. Let's hope that we will soon see software that can exploit those 16+core babies. 'The problem of multi-core programming is staring at us right now. I am not sure what Intel's and Microsoft's expectations are, but it is quite possible that they are in fact looking at fundamental results from the academic centers to leverage their large work force to polish and realize the ideas that come forth. It calls for a much closer collaboration between the centers and the companies than it appears at first sight.'"

  New EMI Boss Says 'Downloads May Be Good'

  warrior_s writes "Douglas Merrill was just installed as CIO of EMI (one of the big four that forms the RIAA). The ex-Googler recently stated it is a 'poor business model to sue your customers. I don't think that's a sustainable strategy.' Quoted by the Guardian, he was referring to Warner Music, EMI, Vivendi Universal and Sony BMG's current practice of trying to use legal systems around the world to force their customers into buying products rather than using the free P2P networks and independent music sites and services. 'Previously, the music industry has rubbished studies that claim file sharing can have a positive effect on music sales. "I think people will pay," Merrill said. "There is evidence that people we think are not buying music are buying music. They're just not buying it in formats we can measure."'"

Popular Mechanics tech editor Glenn Derene, who first introduced us to Surface in May, seems to have done a complete 180 in this rant, blasting Microsoft for being more obsessed with Surface's novelty as a magnet for image-conscious partners while messing up a rare hardware device — and, surprisingly, the simple software he was told came with it. From Microsoft's official excuse in the article: 'It's actually been a good thing for us,' Pete Thompson, Microsoft's general manager for Surface, told me. 'We were anticipating that the initial deployments were going to be showcase pilots using our own software applications on units to drive traffic. What our partners have decided is that they want to skip that stage and go to an integrated experience where they build their own applications. That's pulled the timeline until this spring.'"

'IT people set up traditional IT networks with the idea of making them secure to operate and defend,' said Elder. 'The traditional security approach is to put up barriers, like firewalls — it's a defense thing — but everyone in an operations network is also part of the [attack] force. We're trying to move away from clandestine operations. We're looking for real physics — a bigger bang resulting in collateral damage.'"

'In comments filed with the Federal Communications Commission, the Internet leader outlined plans for low-power devices that use local wireless airwaves to access the 'white space' between television channels. A Google executive called the plan 'Wi-Fi 2.0 or Wi-Fi on steroids.' Interestingly, Google has Microsoft, Intel, and others on their side in this one. Was this spectrum their target all along?"

NVIDIA's SLI technology was supposed to get a boost today by going from two GPUs to four GPUs with the introduction of Quad SLI but both PC Perspective and HardOCP seem to think that NVIDIA drastically missed the mark by pushing an incredibly expensive upgrade that really does nothing for real-world game play and performance.   Windows 7 Likely Going Modular, Subscription-based

  Microsoft CRM writes "When Windows 7 launches sometime after the start of 2010, the desktop OS will be Microsoft's most 'modular' operating system to date. That's not necessarily a good thing, of course; Windows Vista is a sprawling, complex OS. From Microsoft's perspective, though, there are many possible benefits. The OS's developers can add/remove functionality module by module. New modules could be sold post-launch, keeping revenue streams strong. A modular approach could also allow the company to make functionality available on a time-limited basis, potentially allowing users to 'rent' a feature if it's needed on a one-off basis. Microsoft is already testing 'pay as you go' consumer subscriptions in developing countries."

  Justice Dept. Approves XM/Sirius Merger

The transaction was approved without conditions, despite opposition from consumer groups and an intense lobbying campaign by the land-based radio industry. 'In explaining the decision, Justice officials said the options beyond satellite radio -- digital recordings, high-definition radio, Web radio -- mean that XM and Sirius could merge without diminishing competition. "There are other alternatives out there," Assistant Attorney General Thomas O. Barnett said in a conference call. "We just simply found that the evidence didn't indicate that it would harm consumers."'"

  FBI Looks Into Chinese Role in Darfur Site Hack

Now the BBC is reporting that the Save Darfur Coalition has called in the FBI on what appears to be a similar matter. Allyn Brooks-LaSure, a spokesman with the group, doesn't know who is behind the attacks, but he said the IP addresses of the computers that had hacked his organization were from China. Save Darfur has been trying to get China, one of Sudan's largest trading partners, to pressure Sudan's government into stopping the mass killings in Darfur's ongoing civil war. 'Someone in Beijing is trying to send us a message,' Brooks-LaSure said. Probably the same message they're sending by continuing to shut down video sites covering the Tibetan unrest."

  China Bans Horror Movies

  KublaiKhan writes "According to an article on Reuters, the Chinese censors have decided that horror movies are verboten. 'Offending content included "wronged spirits and violent ghosts, monsters, demons, and other inhuman portrayals, strange and supernatural storytelling for the sole purpose of seeking terror and horror," the administration said. This is apparently a sort of Chinese version of the Jack Thompson effect, as the "mental health of adolescents" is cited as one of the reasons for the ban. Presumably, this ban — much like the spitting ban — is intended to improve China's image in the rest of the world before the Olympics open; but given the Streisand effect, would this ban perhaps unintentionally spur a surge of horror movie popularity in China?" Blizzard has had trouble with skeletons in World of Warcraft , and I imagine this decision stems from similar objections.

'This new form of encryption will be implemented in BitTorrent clients including uTorrent, so Comcast subscribers are free to share again. The goal of this new type of encryption (or obfuscation) is to prevent ISPs from blocking or disrupting BitTorrent traffic connections that span between the receiver of a tracker response and any peer IP-port appearing in that tracker response, according to the proposal.'"

Domain name 'tasting', which involves a free five day trial of a domain name, was the big culprit. From the article: 'In some cases ... the committee found that a separate practice of domain name tasting may be causing problems. That refers to someone testing the financial viability of a name for up to five days and then returning it for a full refund, using a loophole in registration policies. Domain tasting can tie up millions of Internet addresses, including ones someone checks but does not buy.' If you check for availability of a website and someone sees you do it and they reserve it before you, it's fair play."

  Videogames Doomed for a 'Comics-like Ghetto'?

  At the Newsweek blog LevelUp, journalist N'Gai Croal wrote this week about the sometimes-precarious position of videogames in popular culture. The frustrations of legislators, lawyers, and 'pro-family' groups aside, the popularity and record sales of the gaming industry would seem to indicate rising stock for gaming as an art form in the US. And yet, there are some folks who see gaming as just another fad, which in some time will be equal in popularity to comic books or tabletop roleplaying. N'Gai starts to form his response by noting that learning to play videogames is considerably easier than developing an appreciation for literature of any kind. He then goes on to note that the (oft-cited) lack of weighty subjects in gaming is more due to the 'pop culture' nature of the hobby than the medium itself. "Popular fiction generally outsells literary fiction. Summer blockbusters generally out-gross arthouse films. Is this any different from, say, Call of Duty 4: Modern Combat out-NPD-ing BioShock last year, or Madden doing the same to Shadow of the Colossus in 2005?" He discusses some ways to address that, but do you have any solutions? Or are games doomed to be the playthings of adolescent boys for the rest of the century? (And yeah, I resent the 'comics ghetto' label too.)

'There are now approximately 68,000 rogue DNS servers across the Internet, The authenticity of the sites such servers redirect to varies greatly, from near-perfect copies to laughably bad, but the problem they represent is quite serious. Once an end user's computer has been modified to use a poisoned DNS server, the system can be directed to any fake web site the malware author feels like serving up.'"

  UK ISPs Resistant to Monitoring Users

The government seeks to have ISPs turn off the access of users who are 'persistent pirates'. The ISPs are citing technical and legal reasons for why they do not wish to do this. Legals reasons include surveillance laws which prohibit ISPs from monitoring a user's data unless compelled by a warrant. Technical reasons include an inability to accurately identify copyrighted material that is legally being transferred over p2p clients, and copyrighted material that is being transferred illegally over p2p clients."

'Steven Hirsch, the co-chairman and co-founder of Vivid Entertainment, is to deliver this message on Saturday in New Haven, Connecticut as he addresses an army of Yale University MBA candidates. "Responsible companies in the adult industry such as ours have done a great deal to deter minors from accessing adult material," Hirsch proclaims from inside a Vivid press release.   Cell Phone Use Study Sees Increased Cancer Risk

  Dotnaught writes "Frequent cell phone users face a 50% greater risk of developing tumors in the salivary glands than those who don't use cell phones, according to a recently published study. The study, led by Tel Aviv University epidemiologist Dr. Siegal Sadetzki, appeared last December in the American Journal of Epidemiology 'Sadetzki's findings are sure to add to confusion surrounding the already contentious debate about the health effects of cell phone radiation. Many other studies in recent years have found no increased risk of cancer due to mobile phone use, but a few have stopped short of ruling the possibility out and a few have said increased risk of cancer is small but real.'. Even with the increased risk, however, you're still about three times more likely to die in a car crash in a given year."

  Newspaper Ad Network Shuns Google, Yahoo, MS

It will let advertisers place ads on media sites in 27 major markets, and let them target readers by content type, demographic information, and online behavior. Notably absent from the deal: Google, Yahoo and Microsoft. Both Google and Yahoo have their own ad networks focused on newspapers, but, as the article says, 'if newspapers develop better ways to sell their own online ads, they may not have to share revenue with their Web counterparts such as Yahoo and Google.'"

  Scientists Find Solar System Like Ours

Of the 250 or so exoplanets found thus far, 'few of them are in systems that even faintly resemble our own. In many cases, giant Jupiter-like planets are whizzing around inside the orbit of Mercury,' whereas in this new system, 'a planet about two-thirds of the mass of Jupiter and another about 90 percent of the mass of Saturn are orbiting a reddish star about half the mass of the Sun, at about half the distances that Jupiter and Saturn circle our own Sun.' The researchers used gravitational microlensing to detect the planets, and two of the lead authors of the paper to be published in Science are amateur astronomers, one of whom describes herself as 'an ordinary New Zealand mother.'"

They want to create a sustainable transportation system by using hydrogen-powered cars. They would like to create an infrastructure where people could use a liquid fuel for driving while the carbon emission in their vehicles is trapped for later processing at a fueling station. 'The carbon would then be shuttled back to a processing plant where it could be transformed into liquid fuel.' Where will all this liquid carbon be stored? The researchers don't know. They suggest that it could be stored in geological formations or under the oceans."

  US To Shoot Down Dying Satellite

We discussed the device's decaying orbit late last month. The Associated Press has learned that the option preferred by the Bush administration will be to fire a missile from a U.S. Navy cruiser, and shoot down the satellite before it enters Earth's atmosphere. 'A key concern ... was the debris created by Chinese satellite's destruction -- and that will also be a focus now, as the U.S. determines exactly when and under what circumstances to shoot down its errant satellite. The military will have to choose a time and a location that will avoid to the greatest degree any damage to other satellites in the sky. Also, there is the possibility that large pieces could remain, and either stay in orbit where they can collide with other satellites or possibly fall to Earth.'"

  UK ISPs Want Copyright Holders to Pay if Users Sue

They're worried that when users are wrongly blamed for piracy, as has happened in several widely-reported investigations already, they will turn around and sue their ISP. The ISPs, of course, think that the record companies — or whoever else wrongly identified the file sharers — should be the ones to pay out any such judgments. The British Phonographic Industry, however, disagrees and wants the ISPs to simply use their Terms of Service to disconnect people. Apparently, that means they think that the ToS should be able to remove any legal recourse people might otherwise have against being misidentified."

  Nanowires Allow For Electricity-Generating Clothing

The cloth is newly developed by scientists in the US, and can produce up to 80 milliwatts per square metre. It is made from brush-like fibres composed of a Kevlar stalk surrounded by zinc oxide nanowire crystals that generate electricity through the piezoelectric effect. They can be grown on any substrate, including hair. The power harnessed from this effect could be used for anything from cosmetic components to the powering of medical devices."

  Laser Light Re-creates 'Black Holes' in the Lab

The team's observations confirm predictions made by cosmologists and now they are trying to prove Hawking's hypothesis of escaping particles, dubbed Hawking radiation. 'The first pulse distorts the optical properties of the fibre simply by traveling through it. This distortion forces the speedy probe wave to slow down dramatically when it catches up with the slower pulse and tries to move through it. In fact, the probe wave becomes trapped and can never overtake the pulse's leading edge, which effectively becomes a black hole event horizon, beyond which light cannot escape.'"

  EU Commissioner Proposes 95 year Copyright

He also wishes to investigate options for new levies on blank discs, data storage and music and video players to compensate artists and copyright holders for 'legal copying when listeners burn an extra version of an album to play one at home and one in the car ... People are living longer and 50 years of copyright protection no longer give lifetime income to artists who recorded hits in their late teens or early twenties, he said.'"

  Animated Film Set To Kick Off Star Wars TV Show

  Sasseen writes "George Lucas has announced that the animated Star Wars television show, which we've discussed previously, will be kicking off with a feature-length theatre release. Lucas felt that, 'there were a lot more 'Star Wars' stories left to tell. I was eager to start telling some of them through animation and, at the same time, push the animation forward.' A fully animated film will be released in theaters on August 15 with a TV series of more than 30 episodes planned to follow on Cartoon Network and TNT. Also of note from the article, 'A new character named Ahsoka, Anakin's padawan, will be the first female Jedi to be a character of focus'."

  New Legislation Could Eventually Lead to ISP Throttling Ban

  An anonymous reader writes "Comcast's response to the FCC may have triggered a new avenue of discussion on the subject of Net Neutrality. Rep. Ed Markey (D — Mass.), who chairs the House Subcommittee on Telecommunications and the Internet, introduced a bill yesterday whose end result could be the penalization of bandwidth throttling to paying customers. 'The bill, tentatively entitled the Internet Freedom Preservation Act of 2008, would not actually declare throttling illegal specifically. Instead, it would call upon the Federal Communications Commission to hold a hearing to determine whether or not throttling is a bad thing, and whether it has the right to take action to stop it.'"

The exact timeline is a tad uncertain, but where XML is going isn't. XML's future lies with the Web, and more specifically with Web publishing. 'Word processors, spreadsheets, games, diagramming tools, and more are all migrating into the browser. This trend will only accelerate in the coming year as local storage in Web browsers makes it increasingly possible to work offline. But XML is still firmly grounded in Web 1.0 publishing, and that's still very important.'"

'With enough lock-in, a company can protect its market share even as it reduces customer service, raises prices, refuses to innovate and otherwise abuses its customer base. It should be no surprise that this sounds like pretty much every experience you've had with IT companies: Once the industry discovered lock-in, everyone started figuring out how to get as much of it as they can.'"

  Do Not Call Registry Set to Become Permanent

  coondoggie passed us a NetworkWorld article about an initiative by the Senate to transform the Do Not Call list into a permanent institution. Originally individuals on the list were to have their place on the list revoked; up to a third of the people who signed up might have fallen off the list by the Autumn without renewing legislation. A move by the Senate this past Wednesday will permanently prevent salesmen from calling those who have registered for the list. "Aside from what telemarketing junk the bill does prevent, experts note what may also be a big deal is a provision that is NOT in this bill and that is protection for those other annoying time wasters: political robo calls."

  Cell Hits 45nm, PS3 Price Drop Likely to Follow

  Septimus writes "At this weeks ISSCC, IBM announced that the Cell CPU used in the PlayStation 3 will soon make the transition to IBM's next-gen 45nm high-k process. 'The 45nm Cell will use about 40 percent less power than its 65nm predecessor, and its die area will be reduced by 34 percent. The greatly reduced power budget will cut down on the amount of active cooling required by the console, which in turn will make it cheaper to produce and more reliable (this means fewer warrantied returns). Also affecting Sony's per-unit cost is the reduction in overall die size. A smaller die means a smaller, cheaper package; it also means that yields will be better and that each chip will cost less overall.'"

  PC World Tests Final Version of Vista SP1

Here's the bottom line: 'File copying, one of the main performance-related complaints from Vista users, was significantly faster. But other tests showed little improvement and, in two tests, our experience was actually a little better without the service pack installed than with it.'"

  Install Copyright Filters on PCs, Says RIAA Boss

  Don't squeeze the Sherman writes "At a conference last week, RIAA president Cary Sherman said he didn't support mandatory filtering by ISPs, but in a video clip posted by Public Knowledge, Sherman offers a far more troubling 'solution': installing filters on users' PCs. From Ars Technica's coverage: 'The issue of encryption "would have to be faced," Sherman admitted after talking about the wonders of filtering. "One could have a filter on the end user's computer that would actually eliminate any benefit from encryption because if you want to hear [the music], you would need to decrypt it, and at that point the filter would work."'"

  Modu Unveils Modular, Transformer-style Phone

Instead of giving you the finished product, you get a base unit and a choice of 'sleeves', which you can plug the base unit into and turn it into a variety of devices. "If, for example, you're going out clubbing, you can pop it into a fashion sleeve with a fancy design. If you're on a business trip and you need a phone with a Qwerty keypad and large screen, you just have to pop it into a 'jacket' with those features." There's also the option to plug it into a satellite navigation device or even a car stereo. While it seems like an interesting system, I wonder whether modular devices are better than buying standalone products or all-in-one products?"

  White Paper Decries RIAA Attempts To Raise Infringement Payouts

'Noting that the courts can currently award massive statutory damages without rightsholders having to demonstrate that they have suffered any actual harm, the white paper calls current copyright law a "carefully designed compromise" meant to balance the interests of both parties ... The authors of the white paper paint a dreary future where "copyright trolls" file lawsuits in order to rake in massive amounts of statutory damages, where innovation is stifled, and where artists are afraid to "Recut, Reframe, and Recycle" because of the financial risks involved.'"

  Users Worldwide Feel Internet Is 'Safer'

  buzzardsbay writes "Baseline Magazine is reporting on a study by Cisco that teases out the differing attitudes about online security among users across the globe. For instance, remote workers worldwide think the internet is getting safer ... except the folks in Italy and Germany. These folks also have a lot of faith in their corporate IT departments as 51 percent said their work computers are more secure than their personal PCs, and nearly half (45 percent) believe they are more vulnerable to malware and hacks when they're working outside their corporate perimeter. Irony of ironies, the Brazilians hold Net security in the highest regard."

  Duke Nukem Forever 'Confirmed' For Late 2008

  An anonymous reader writes "A Dallas newspaper is claiming that the long-in-development title Duke Nukem Forever is headed for retail release in late 2008. Unfortunately, game creator 3D Realms says that's not exactly what they meant. 'What the modest Texas newspaper actually seems to suggest is that 3D Realms is "on target" to release the mythical sequel sometime this year, though company president Scott Miller adds, "we may miss the mark by a month or two" (wink, wink). Miller also hinted that "hitting the big three" (in this case, PC, Xbox 360 and PS3) is the obvious development strategy, but he continued to stress that 3D Realms has not "formally announced any platforms for DNF."'"

  Time-Warner Planning AOL Split

  Two years ago the word was AOL was planning a split from Time-Warner, because it was so successful. Now Time-Warner is considering a split of its own, deciding whether or not to separate the two 'halves' of the AOL pie. The split would see its 'access' ISP side made into an entity separate from its 'audience' side, consisting of portals, advertising and blogs. "[Time-Warner chief executive Jeffrey Bewkes] also said [AOL's] 84 percent ownership stake in Time Warner Cable is 'less than optimal' for both companies. He said the two companies are talking about operating improvements and changes to the ownership structure. The chief financial officer, John Martin, said it will take 'several more months' to separate the AOL businesses 'because it's fairly complicated.' The company expects AOL's advertising revenue for the first quarter of 2008 to be 'essentially flat to down slightly' versus the year-earlier quarter, he said."

The German researchers have found a genetic factor that affects our ability to learn from our errors. The scientists demonstrated that men carrying the A1 mutation are less successful at learning to avoid mistakes than men who do not carry this genetic mutation. This finding has the potential to improve our understanding of the causes of addictive and compulsive behaviors."

  Cyberwarfare in International Law

In a recent op-ed piece and a detailed scholarly paper, legal scholar Duncan Hollis raises the question of whether existing international law is adequate for regulating cyberwarfare. He concludes that it is not: 'Translating existing rules into the IO context produces extensive uncertainty, risking unintentional escalations of conflict where forces have differing interpretations of what is permissible. Alternatively, such uncertainty may discourage the use of IO even if it might produce less harm than traditional means of warfare. Beyond uncertainty, the existing legal framework is insufficient and overly complex. Existing rules have little to say about the non-state actors that will be at the center of future conflicts. And where the laws of war do not apply, even by analogy, an overwhelmingly complex set of other international and foreign law rules purport to govern IO.'"

  Scientists Build Possibly The First Man-Made Genome

  hackingbear writes "Wired is reporting that researchers have created the longest synthetic genome to date by threading together four long strands of DNA. 'Leading synthetic biologists said with the new work, published Thursday in the journal Science, the first synthetic life could be just months away — if it hasn't been created already. [...] The ability to synthesize longer DNA strands for less money parallels the history of genetic sequencing, where the price of sequencing a human genome has dropped from hundreds of millions of dollars to about $10,000. Just a few years ago, synthesizing a piece of DNA with 5,000 rungs in its helix, known as base-pairs, was impossible. Venter's new synthetic genome is 582,000 base-pairs.' As a programmer, I'm most excited by the possibility of a new platform and the programming jobs that will be created by it."

'In this brave new Web 2.0 world, it's almost a badge of honor to have a Web site name that only hints at what the user will find there (see Flickr) or is so opaque as to offer no clue at all as to what the Web site is about (see del.icio.us). It's easy to forget the first Internet gold rush of the mid-to-late '90s, when dot-com domain names based on ordinary (and, investors hoped, marketable) nouns and verbs were snapped up by hopeful companies from the humble geeks who had purchased them (often ironically) in the early '90s.'"

  Mystery Malware Affecting Linux/Apache Web Servers

  lisah writes "Reports are beginning to surface that some Web servers running Linux and Apache are unwittingly infecting thousands of computers, exploiting vulnerabilities in QuickTime, Yahoo! Messenger, and Windows. One way to tell if your machine is infected is if you're unable to create a directory name beginning with a numeral. Since details are still sketchy, the best advice right now is to take proactive steps to secure your servers. 'We asked the Apache Software Foundation if it had any advice on how to detect the rootkit or cleanse a server when it's found. According to Mark Cox of the Apache security team, "Whilst details are thin as to how the attackers gained root access to the compromised servers, we currently have no evidence that this is due to an unfixed vulnerability in the Apache HTTP Server." We sent a similar query to Red Hat, the largest vendor of Linux, but all its security team could tell us was that "At this point in time we have not had access to any affected machines and therefore cannot give guidance on which tools would reliably detect the rootkit."'"

  When Are Kids Old Enough to Play Videogames?

  A piece at the MTV Multiplayer blog is exploring the issue of kids and gaming, wondering aloud how old is 'old enough'. A recent CES talk indicated that you should wait until at least seven to introduce your children to Mario, and we've talked in the past about the educational role games can have. MTV's Tracey John spoke to a pair of mothers who offered their own opinions on this topic: "When I asked Alisa why she thought that games weren't imaginative and explained that many games have challenging, puzzle-solving elements, she conceded a little but remained skeptical. 'Honestly, I haven't really explored video games thoroughly, and I'm sure there are video games that fit more the bill of something that I'd be interested in, but I'm kind of hard-pressed to find a game that's like reading a book or something like that. I understand the kids like it, so I allow them to do it; it's monitored but it's not my favorite thing for them to be doing.'" What's the right age for a kid to start playing games? Do you see games as more or less acceptable than traditional kid pastimes like TV or reading? Does it matter if the parents are gaming-savvy?

  Teen Takes On Donor's Immune System

  Leibel writes "The Australian ABC News is reporting that a 15-year-old Australian liver transplant patient has defied modern medicine by taking on her donor's immune system. Demi-Lee Brennan had a liver transplant. Nine months later, doctors at Sydney's Westmead Children's Hospital were amazed to find the teenager's blood group had changed to the donor's blood type. They were even more surprised when they found the girl's immune system had almost totally been replaced by that of the donor, meaning she no longer had to take anti-rejection drugs. 'Dr. Michael Stormon says his team is now trying to identify how the phenomenon happened and whether it can be replicated. "That's probably easier said than done... I think it's a long shot," he said. "I think it's a unique system of events whereby this happened. "We postulate there's a number of different issues - the type of liver failure that she had, some of the drugs that we use early on to suppress the immune system and also that she suffered an infection with a virus called CMV, or cytomegalovirus, which can also suppress the immune system."'"

'Why are all these companies so excited? Because the 60 MHz of spectrum that's about to be auctioned is the last prime real estate for mobile communications that will be available in the U.S. for decades to come ... Some pundits (that would be me) think Google will bid to win its spectrum block, then will trade that block to Sprint/Nextel for some of that company's 2.5-GHz WiMAX licenses that are far better suited for data.'   Has the Higgs Boson Particle Field Been Hiding in Plain Sight?

A theorist at Michigan state is arguing that scientists may have already found evidence for the elusive particle. The key appears to be that the particles that make up the Higgs field are of various 'strengths', and some of those particles may tug on others very weakly. "The lightest Higgs can be very light indeed, but it would not have been seen at [CERN's Large Electron-Positron (LEP)], because LEP experimenters were looking for an energetic collision that made a Z that then spit out a Higgs. That wouldn't happen very often if the lightest Higgs and the Z hardly interact. 'Just within the simplest supersymmetric model, there's still room for Higgs that is missed,' Yuan says. However, this lightweight Higgs is not exactly the Higgs everyone is looking for, says Marcela Carena, a theorist at Fermilab. 'The Higgs they are talking about is not the one responsible for giving mass to the W and Z,' she says. It can't be because it hardly interacts with those particles, Carena says. Indeed, in Yuan's model, the role of mass-giver falls to one of the heavier Higgses, which is still heavier than the LEP limit, she notes."

  FTC Defends Ethernet From Patent Troll

  I Don't Believe in Imaginary Property writes "The FTC has put a stop to Negotiated Data Solutions, a patent troll that bought a patent on an important part of the Ethernet networking standard and tried to jack up the royalties for licensing it. In a consent decree (pdf), N-Data agreed to continue licensing the patent at the formerly promised rates. 'Whatever the merits of the decision, it shows that the FTC sees the value of standards and will be on the lookout for any behavior that could undermine these standards-setting process. That alone could keep companies honest when they enter the standards process. Standards-setting bodies have also become more sophisticated over the years (after being burned in several high-profile cases), and now do a better job at forcing involved companies to disclose and license patents.' The IEEE voted back in 2002 to make patent letters irrevocable, which could have prevented this, but neglected to make that clause retroactive."

  Internet Group Declares War on Scientology

  Darkman, Walkin Dude writes "An internet group calling itself Anonymous has declared war on the Church of Scientology, in the form of an ominous posting to the YouTube site. 'In the statement, the group explained their goal as safeguarding the right to freedom of speech. "A spokesperson said that the group's goals include bringing an end to the financial exploitation of Church members and protecting the right to free speech, a right which they claim was consistently violated by the Church of Scientology in pursuit of its opponents." The press release also claimed that the Church of Scientology misused copyright and trademark law in order to remove criticism from websites including Digg and YouTube. The statement goes on to assert that the attacks from the group "will continue until the Church of Scientology reacts, at which point they will change strategy".' It should be noted that Slashdot users have had interactions with Scientology in the past as well."

  Bill Gates Calls for a 'Kinder Capitalism'

  Strudelkugel writes "The Wall Street Journal reports that Microsoft's Chairman Bill Gates is going to call for a revision of capitalism. He will argue that the economics that drive much of the world should use market forces to address the needs of poor countries, which he feels are currently being ignored. 'We have to find a way to make the aspects of capitalism that serve wealthier people serve poorer people as well,' Mr. Gates will say in a speech at the World Economic Forum in Davos, Switzerland. 'Key to Mr. Gates's plan will be for businesses to dedicate their top people to poor issues — an approach he feels is more powerful than traditional corporate donations and volunteer work. Governments should set policies and disburse funds to create financial incentives for businesses to improve the lives of the poor, he plans to say. Mr. Gates's argument for the potential profitability of serving the poor is certain to raise skepticism, and some people may point out that poverty became a priority for Mr. Gates only after he'd earned billions building up Microsoft. But Mr. Gates is emphatic that he's not calling for a fundamental change in how capitalism works.'"

  ICANN Writes US Government Requesting Independence

  Combat Wombat writes with word that IP address and domain name overseer ICANN has put in a request to the US government, asking to be freed from ties to the United States. A 'lengthy' report was sent to the US Dept. of Commerce, and covers the numerous steps the organization has already completed along the road to independence. The BBC reports that a meeting will be held soon in response to the report, a reaction to the expected end of US control. "The meeting marks the half-way point for the Joint Project Agreement (JPA) under which ICANN was tasked to comply with a series of 'responsibilities' deemed necessary for its release from official oversight. The JPA grew out of the original Memorandum of Understanding that established Icann and signalled the beginning of the end for US control."

  NASA Vets & Administration Clash Over Moon Plans

  mattnyc99 writes "There's a serious feud brewing this week over the Bush administration's plan for a manned mission to the Moon as an eventual stepping stone to Mars. The Planetary Society, a top group of former mission managers, space-based scientists and NASA astronauts argues, is set to rebuke the Moon plan at a conference next month in favor of hopskotching an asteroid on the way to the Red Planet. Agency chief Michael Griffin issued an abnormally strong response to the society, calling it an overly political criticism of Bush for a plan that he says was 'the best legislative guidance NASA has ever had.' Either way, it's clear that the stars are aligning for the whole space race to be reconsidered as a new administration steps into the White House. So far Clinton and Obama (who just added his) are the only contenders with space proposals."

  DRM-Free Music Spells Trouble?

His view is that our digital economy will collapse this way, and it could be followed by countless others. 'The music industry's moves have been terrified reactions to staunch the bleeding of millions of dollars in revenue down the drain. For maybe a year, music companies thought they had the situation under control, but then album sales tumbled. Retailers, musicians, and some music-industry execs thought DRM was the culprit, and they soon joined the chorus of consumers calling for its head. Now consumers are getting their wish, and the music industry will continue to crumble. Giving up control of content and giving it away free are not rational ideas in a market economy, yet everyone's cheering.'" Is the removal of restrictions from our media really that big a deal?

  MIT Student Plans to Take on RIAA

The anonymous student told The Tech that he is 'the victim of a fishing expedition by the RIAA,' and is 'disappointed that MIT isn't going to step up ... Other schools like Boston University and the University of Oregon have resisted RIAA subpoenas of student records more actively than MIT has, he said'. Maybe his attorneys will be able to get some assistance from some of the Harvard Law School students in Professor Nesson's 'Evidence' class, who have been assigned — as part of their coursework — the drafting of a motion to quash an RIAA subpoena."

  Mozilla Celebrates Its 10th Birthday

It's been a long, strange trip from being the once-dominant browser, going down to almost nothing, and returning to something like 25% of the browser market. 'With a sliding market share, Netscape decided to focus on its enterprise oriented products and gave away the browser but most importantly allow volunteers to work on the product. Mozilla was nothing but Netscape's user agent (the name a browser uses to contact the web server), a reminder of the first Netscape code name.   Saving in OOXML Format Now Probably A Bad Idea

  orlando writes "Much drama is unfolding prior to the OOXML Ballot Resolution Meeting in Geneva, currently schedule for the end of February. After that there's a subsequent 30 day period while countries can still change their vote. As a result, Bob Sutor is recommending that saving your documents in OOXML format right now is probably about the riskiest thing you can do, if you are concerned with long term interoperability. At this point nobody has the vaguest idea what OOXML will look like in February, or even whether it will be in any sort of stable condition by the end of March. 'While we are talking about interoperability, who else do you think is going to provide long term complete support for this already-dead OOXML format that Microsoft Office 2007 uses today? Interoperability means that other applications can process the files fully and not just products from Microsoft. I would even go so far as to go back to those few OOXML files you have already created and create .doc, .ppt, and .xls versions of them for future use, if you want to make sure you can read them and you don't want to commit yourself to Microsoft's products for the rest of their lives.'"

  IE8 May Not Pass the Acid2 Test After All

The article predicts that IE8 will not pass the Acid2 test after all: '[Another] scenario could be that Microsoft requires Web pages to change the default settings by flagging that they really, really want to be rendered correctly. Web pages already have a way to say this (called doctype switching, which is supported by all browsers), but Microsoft has all but announced that IE8 will support yet another scheme. If the company decides to implement the new scheme, the Acid2 test — and all the other pages that use doctype switching — will not be rendered correctly.' Microsoft's IE8 render modes have been previous discussed here, and they've caused an uproar in the web development community. According to the scheme, authors must put Microsoft-specific <meta> tags into their pages in order for them to be rendered correctly. I doubt Acid2, nor Acid3 will have Microsoft extensions in them."

  Novels Composed on Cellphones Topping Japanese Best Seller Lists

Recent Japanese best-seller lists have been heavy with these texts, many of them actually written on cellphones for a cellphone reading audience. Commentators note the popularity of this form of literature coincides with cell providers moving to unlimited data packages. 'The affordability of cellphones coincided with the coming of age of a generation of Japanese for whom cellphones, more than personal computers, had been an integral part of their lives since junior high school. So they read the novels on their cellphones, even though the same Web sites were also accessible by computer. They punched out text messages with their thumbs with blinding speed, and used expressions and emoticons, like smilies and musical notes, whose nuances were lost on anyone over the age of 25.'"

  Personal Weather Stations Helping With Weather Forecasting

  Weather Storm writes "Weather information from thousands of personal weather stations are being used for weather forecasting by several private and government agencies, including the National Oceanic and Atmospheric Administration (NOAA) and Department of Homeland Security (DOH). The Citizens Weather Observation Program (CWOP) was created by a few amateur radio operators experimenting with transmitting weather data with packet radios, but it has expanded to include internet-only weather stations as well . As of September 2007, nearly 5,000 stations world-wide reported weather data regularly to CWOP's FindU database. The weather data is forwarded every 15 minutes to NOAA's Meteorological Assimilation Data Ingest System (MADIS), checked for temporary and spatial consistency, than utilized by computer forecast models and internal forecast verification programs. In a Febuary 2007 report (pdf) DOH listed CWOP as a national assets to the 'BioWatch' Network, stating that data from personal weather station could be useful in weather forecasts for hazardous releases. In 2007, the FindU server received 422,262,687 weather reports which is a 29.5% increase over 2006." They certainly come in stylish shapes.

  Researchers Work To Perfect Computerized Lip Reading

Lip-reading is extremely hard for humans to master, but a software-based system has several benefits over even the most highly trained expert. The ultimate goal of the project is to convert lip-read speech into text. 'Apart from being extremely helpful to hearing-disabled individuals, researchers say that such a system could be used to noiselessly dictate commands to electronic devices equipped with a simple camera - like mobile phones, microwaves or even a car's dashboard. England's Home Office Scientific Development Branch ... is currently investigating the feasibility of using lip-reading software as an additional tool for gathering information about criminals or for collecting evidence.'"

  Online Crime Seen as Growing Threat to Business, Politics

  BobB passed us a link to a NetworkWorld article, exploring the ongoing realization in business circles of the dangers online criminals pose. The piece raises the possibility that criminal elements are gaining access to US research labs in an effort to ferret out corporate and governmental information. One institute referred to in the article states: "Economic espionage will be increasingly common as nation-states use cyber theft of data to gain economic advantage in multinational deals. The attack of choice involves targeted spear phishing with attachments, using well-researched social engineering methods to make the victim believe that an attachment comes from a trusted source." We just recently discussed possible hacker involvement in several municipal blackouts.

  Design of Next-Gen NASA Rocket Showing Flaws

Work on the project has revealed that the first few minutes of flight could see 'violent shaking', a serious flaw that might destroy the craft soon after launch. 'NASA officials hope to have a plan for fixing the design as early as March, and they do not expect it to delay the goal of returning astronauts to the moon by 2020. The shaking problem, which is common to solid rocket boosters, involves pulses of added acceleration caused by gas vortices in the rocket similar to the wake that develops behind a fast-moving boat.'

And you control the image on the screen by rotating or moving your phone. As says one of the researchers, 'it feels like a much more natural way to interact and exchange data.' The technology might first be used in shopping malls to buy movie tickets or to interact with advertising displays."

  AI Taught How To Play Ms. Pac-Man

Software constructs been taught to play games like chess and checkers since the 50s, but the Department of Information Systems at Eotvos University in Hungary is working to adapt that thinking to more modern titles. Besides Ms. Pac-Man, game like Tetris and Baldur's Gate assist these programs in mapping different behaviors onto their artificial test subjects. "Szita and Lorincz chose Ms. Pac-Man for their study because the game enabled them to test a variety of teaching methods. In the original Pac-Man, released in 1979, players must eat dots, avoid being eaten by four ghosts, and score big points by eating flashing ghosts. Therefore, a player's movements depend heavily on the movements of ghosts. However, the ghosts' routes are deterministic, enabling players to find patterns and predict future movements. In Ms. Pac-Man, on the other hand, the ghosts' routes are randomized, so that players can't figure out an optimal action sequence in advance."

  FCC Will Test Internet Over TV Airwaves, Again

  Weather Storm writes "According to MSNBC.com, the FCC will try again to test prototypes on Jan. 24 for transmitting high-speed Internet service over unused television airwaves. The devices were developed by Microsoft and Motorola, among other corporate partners, and will be tested in laboratory and real-world conditions for three months. 'Last year, a high-technology coalition — which included Microsoft, Google Inc., Dell Inc., Hewlett-Packard Co., Intel Corp. among others — submitted prototypes they said could transmit broadband Internet service over unlicensed and unused TV spectrum, known as "white spaces." Television broadcasters and the wireless microphone industry say such devices could interfere with programming. The Initial prototype testing failed last July because the devices did not reliably detect and avoid TV programming signals and could have caused interference. If the tests are successful this time and the devices are approved, the coalition plans to introduce commercial devices for sale after the digital television transition in February 2009.'"

  Aftermath of Distant Planetary Collision?

The object, known as 2M1207B, has puzzled astronomers since its discovery because it seems to fall outside the spectrum of physical possibility. Its combination of temperature, luminosity, and age do not match up with any theory. 'Hot, post-collision planets might be a whole new class of objects we will see with the Giant Magellan Telescope', said Eric Mamajek of the Harvard-Smithsonian Center for Astrophysics."

  New Hampshire Primaries Follow-Up Analysis

The article deals with the O'Dell machine/hand-count table that has been circulating through emails. It also points out the combination of factors that resulted in such an odd symmetry of numbers, although the article notes that these numbers have been corrected. The corrections still indicate a discrepancy among the tallies. The article also goes on to talk about the nature of the communities that arrived at these numbers and what/how the handcounts proceeds. This process has been inconclusive; something that does not bode well for the rest of the primaries and indeed the election itself, as only 16 states currently mandate both a voter-verified paper trail (VVPT) and a random manual audit of election results."

  EU Regulators Open New Microsoft Investigations

  The New York Times is reporting on two new investigations into Microsoft business practices opened by EU antitrust regulators. The new cases center on the company's positioning of Office and Internet Explorer, and were apparently partially prompted by Microsoft's earlier heel-dragging. "'It would have been preferable if these issues could have been resolved amicably with Microsoft,' said Jonathan Todd, a spokesman for the European competition commissioner, Neelie Kroes. 'But that has not proved to be the case. Therefore we have opened these formal investigations. That does not prove there is a violation. We will only be able to come to a conclusion after investigations.' The legal battle that ended last year involved the bundling of a media player with Windows and the availability of information required to make rival software operate smoothly with Microsoft products. In September, the Court of First Instance, Europe's highest after the European Court of Justice, endorsed the commission's 2004 decision to impose record fines on Microsoft."

  Is Copy Protection Needed or Futile?

  Hugh Pickens writes "Columnist Saul Hansell is hosting a debate about copyright issues and technology on his blog at the New York Times . On one side Rick Cotton, the general counsel of NBC Universal, says that anyone who is intellectually honest must 'acknowledge, confront and speak to the tidal wave of unlawful, wholesale reproduction and distribution of copyrighted content that is currently occurring in the digital world' and that we should be 'identify workable, flexible and effective approaches that reduce piracy without being intrusive and that fully respect other interests such as privacy and fair use.' Tim Wu, a professor at Columbia Law School, responds that 'locks will be broken, and so a business model that depends on locking is very vulnerable' adding that locks may form a part of certain successful business models but 'too much reliance on locking can seriously backfire.' Wu and Cotton will respond to each other and to comments by readers today." As for the man on the street, Panaqqa wrote us with word that the Question Copyright site has posted an interesting video of ordinary people explaining why they think copyright exists. It's pretty clear that most people don't understand it at all.

  Public Request For Microsoft To Release Deprecated File Formats

The maker of Office has made large efforts during the last year to move against the OpenDocument Format (ISO/IEC 26300). These efforts have been producing a lot of commentary regarding the amount of data bound up in the Redmond-based company's proprietary specifications. It's a nasty situation to end up with files that cannot be read because the sole vendor with the documentation for the files has withdrawn permission. ODF is the way forward, or a step forward at the least, with new documents. But for the old documents in the legacy formats, they cannot be read without supporting software and that support requires full access to the specifications."

  'War on Terror' Allies Form Information Consortium

It's spearheading a program labeled 'Server in the Sky', meant to coordinate the police forces of the United States, the United Kingdom, Canada, Australia, and New Zealand to better fight international crime/terrorist groups. The group is calling itself the International Information Consortium. "Britain's National Policing Improvement Agency has been the lead body for the FBI project because it is responsible for IDENT1, the UK database holding 7m sets of fingerprints and other biometric details used by police forces to search for matches from scenes of crimes. Many of the prints are either from a person with no criminal record, or have yet to be matched to a named individual. IDENT1 was built by the computer technology arm of the US defence company Northrop Grumman. In future it is expected to hold palm prints, facial images and video sequences."

In the Late Cretaceous the world was covered with warm-temperate to tropical areas that swarmed with blood-sucking insects. A theory explored by researchers at Oregon State suggests these bugs carried leishmania, malaria, intestinal parasites, arboviruses and other pathogens. Repeated epidemics may have slowly-but-surely worn down dinosaur populations while ticks, mites, lice and biting flies tormented and weakened them. 'After many millions of years of evolution, mammals, birds and reptiles have evolved some resistance to these diseases,' says Researcher George Poinar. 'But back in the Cretaceous, these diseases were new and invasive, and vertebrates had little or no natural or acquired immunity to them.' The confluence of new insect-spread diseases, loss of traditional food sources, and competition for plants by insect pests could all have provided a lingering, debilitating condition that dinosaurs were ultimately unable to overcome."

  Scientist Suggests We Explore 'Universe is a VR Simulation' Theory

He says that the existence of quantum phenomena could be due to the underlying digital nature of the simulation and also claims his VR hypothesis can explain relativity, the big bang and more. It should be possible to perform experiments to prove the hypothesis too. He reasons that if reality was to do something that information processing cannot, then it cannot be virtual."

The site specifically points out the work of Igor Skochinsky at the Reversing Everything website. His work on the Kindle's Root Shell has revealed some fascinating goodies: 'Among the ones uncovered and described on his blog are a basic photo viewer, a minesweeper game, and most interesting, location technology that uses the Kindle's CDMA networking to pinpoint its position. There also are some basic location-based services that call up a Google Maps view to show where you are and nearby gas stations and restaurants.'"

  Researchers Say Wi-Fi Virus Outbreak Possible

Indiana University IT researchers are now saying that a WiFi attack intended to piggyback across unsecured access points could do serious damage in a city like Chicago or New York. By essentially brute-forcing the passwords on insecure routers, a worm-like firmware agent could be introduced to an estimated 20,000 networks in New York City alone. "Although the researchers did not develop any attack code that would be used to carry out this infection, they believe it would be possible to write code that guessed default passwords by first entering the default administrative passwords that shipped with the router, and then by trying a list of one million commonly used passwords, one after the other. They believe that 36% of passwords can be guessed using this technique."

  Firefox Spoofing Bug Puts Passwords At Risk

According to Mr. Raff Firefox fails to sanitize single quotes and spaces in the 'Realm' value of an authentication header. Raff was quoted as saying 'This makes it possible for an attacker to create a specially crafted Realm value which will look as if the authentication dialog came from a trusted site.' This vulnerability was shown to be in the latest Firefox, version 2.0.0.11 and until Mozilla fixes this vulnerability Mr. Raff recommends in his blog 'not to provide username and password to Web sites which show this dialog.'"

  Microsoft Patents Frustration-Detection System

It could then offer to pair you up with someone else doing exactly the same thing who might be able to help you out. Interestingly, they don't appear to use speech recognition to detect abnormal levels of swear words, but that could be due to their past difficulties with speech recognition. 'Physical responses aren't the only things that could trigger this event--taking an abnormally long time to complete a task would do so also--but the biometric aspect is certainly the most unusual. Is this patent a harbinger of a dystopian future where computer users' biorhythms will be monitored to increase efficiency? Unlikely. The idea, which was birthed at Microsoft Research, is simply a more advanced version of user focus group testing that Microsoft (and most other software companies) have been doing for years now.'"

He cites the case of a New York City Police Detective who was secretly taped by a suspect during an interrogation that the detective initially denied took place during the suspect's murder trial, as well as a case involving two parents in Wisconsin who slipped a voice-activated recorder in their son's backpack after suspecting he was being abused by his bus driver. In the first case, even though the detective was later charged with 12 counts of perjury, Elgan notes that the police interrogation probably would not have taken place had the suspect announced to the detective that he was recording the session. In the second case, the tape was initially ruled inadmissible in court because Wisconsin state law prohibits the use of 'intercepted conversations' (it was later allowed as evidence). Elgan argues that there should be no questions about members of the public being allowed to record such interactions."

  Stern Measures Keep NASA's Kepler Mission on Track

  Hugh Pickens writes "NASA's new Space Science Division Director, Dr. S. Alan Stern, appears to be making headway in keeping in space projects like the Kepler Mission at their original budgeted costs. The New York Times reports that Stern's plan is to hold projects responsible for overruns, forcing mission leaders to trim parts of their projects, streamline procedures or find other sources of financing. 'The mission that makes the mess is responsible for cleaning it up,' Stern says. Because of management problems, technical issues and other difficulties on the Kepler Mission, the price tag for Kepler went up 20% to $550 million and the launch slipped from the original 2006 target date to 2008. When the Kepler team asked for another $42 million, Stern's team threatened to open the project to new bids so other researchers could take it over using the equipment that had already been built."

  Antitrust Suit Filed To Halt Apple 'Music Monopoly'

Information Week has the story, a suit charging the company with maintaining an illegal monopoly on the digital music market. "The complaint goes beyond software licensing politics and charges Apple with deliberately designing its iPod hardware to be incompatible with WMA. One of the third-party components in iPods, the Portal Player System-On-A-Chip, supports WMA, according to the complaint. 'Apple, however, deliberately designed the iPod's software so that it would only play a single protected digital format, Apple's FairPlay-modified AAC format,' the complaint states. 'Deliberately disabling a desirable feature of a computer product is known as crippling a product, and software that does this is known as crippleware.'"

  UK Moves to Outlaw 'Hacker Tools'

  twitter writes "New guidance rules for the UK's controversial Computer Misuse Act do not allay fears of impracticality, or of the banning of legitimate IT software: 'The government has come through with guidelines that address some, but not all, of these concerns about dual-use tools. The guidelines establish that to successfully prosecute the author of a tool it needs to be shown that they intended it to be used to commit computer crime. But the Home Office, despite lobbying, refused to withdraw the distribution offense. This leaves the door open to prosecute people who distribute a tool, such as nmap, that's subsequently abused by hackers.'" Somewhat similar legislation recently became law in Germany.

  Office 2003 Service Pack Disables Older File Formats

They did this because the old formats are 'less secure', which actually makes some sense, but only if you got the files from some untrustworthy source. Naturally, they did this by default, and then documented a mind-bogglingly complex workaround (KB 938810) rather than providing a user interface for adjusting it, or even a set of awkward 'Do you really want to do this?' dialog boxes to click through. And of course because these are, after all, old file formats ... many users will encounter the problem only months or years after the software change, while groping around in dusty and now-inaccessible archives."

  With the growing popularity of titanium, some disreputable merchandisers are passing off other materials as the more expensive metal. Popular Science looks at a surefire way to prove what that credit card/crowbar/ring is really made of. "Hold any genuine titanium metal object to a grinding wheel (even a little grindstone on a Dremel tool will do), and it gives off a shower of brilliant white sparks unlike any softer common metal. The sparks are tiny pieces of cut titanium--the friction of the grinder heats them till they burn white-hot. Hold a grindstone to the shackle of a "titanium" padlock from Master Lock, however, and you'll instead see the telltale fine, long, yellow sparks of high-carbon steel."

  Anti-Virus Bug Briefly Identified Windows Explorer as Malware

The security company's systems had decided that a virus called Huhk-C was present in the explorer.exe file, leading to its confinement or, in some cases, deletion. The bug was only live in the wild for two hours, and ended up affecting just one corporate customer and a handful of home users."

  Apple and Google Are Telecom's Newest Stars

  In looking back at 2007, CNet views the smash entrance of Google and Apple onto the telecom scene as a major formative factor for 2008's tech scene. Google in particular is going to be a huge factor in the much-anticipated wireless auction. "Google was instrumental in getting the FCC to adopt auction rules that would ultimately give consumers more choice in the devices they use on these new networks. And in November, Google CEO Eric Schmidt committed the company to bidding in the auction, promising to spend at least $4.6 billion on licenses. Exactly what Google plans to do with the spectrum if it wins licenses is still unknown. But its participation raises the stakes, especially for traditional telephony players."

  Deep Impact Probe to Look for Earth-sized Planets

The spacecraft will pass Earth on New Year's Eve at the beginning of a more than two-and-a-half-year journey to Hartley 2. During the first six months of the journey to Hartley 2, they will use the larger of the two telescopes on Deep Impact to search for Earth-sized planets around five stars selected as likely candidates for such planets. Upon arriving at the comet, Deep Impact will conduct an extended flyby of Hartley 2 using all three of the spacecraft's instruments — two telescopes with digital color cameras and an infrared spectrometer."

  No Right to Privacy When Your Computer Is Repaired

  Billosaur writes "ZDNet's Police Blotter bring us the interesting story of a Pennsylvania man who brought his computer into Circuit City to have a DVD burner installed on his computer and wound up being arrested for having child pornography on his hard drive. Circuit City employees discovered the child pornography while perusing Kenneth Sodomsky's hard drive for files to test the burner, then proceeded to call the police, who arrested Sodomsky and confiscated the computer. Sodomsky's lawyer argued in court that the Circuit City techs had no right to go rifling through the hard drive, and the trial court agreed, but prosecutors appealed and the appeals court overturned the lower court's decision, based on the fact that Sodomsky had consented to the installation of the DVD drive."

  Microsoft Agrees to Release Work Group Protocols

  UnknowingFool writes "Groklaw is reporting that the Protocol Freedom Information Foundation (PFIF) has signed an agreement with Microsoft to release their protocols relating to Windows Work Group Server. The Foundation agrees to pay MS $10,000, and the agreement does not cover patents. This agreement apparently was made to somewhat satisfy the EU Commission complaints. With PFIF's objective to aid open source, this agreement means that the Samba Team may finally get the information they need to fully interoperate with Windows AD servers."

  Microsoft is the Industry's Most Innovative Company?

And while Microsoft came in second to IBM in The Patent Board's 2006 survey, its upcoming 2007 report has Microsoft besting IBM (and even its 2006 report had Microsoft #1 in terms of the "scientific strength" of its patent portfolio). All of which begs the question: Just where is all this innovation going? To Clippy? Consumers and business users don't buy patents. They buy products that make their lives easier or more productive, yet Microsoft doesn't seem to be able to turn its patent portfolio into much more than life support for its existing Office and Windows monopolies. In sum, if Microsoft is so innovative, why can't we get something better than the Zune?"

  NCAA Puts Severe Limits On Sport Event Blogging

Not so. The governing body of the NCAA has released new rules for receiving press credentials and it includes severe limits on live blogging. If you're covering NCAA football, make sure you don't blog more than 3 times in a single quarter. If it's baseball, one post an inning is all you get. If you don't follow the rules expect to get ejected and have your press credentials pulled."

  Narrowing the Space Flight Gap

Between 2010 (the end of the shuttle era) and 2015 (expected date for the launch of the Orion project) the United States will have little or no spaceflight capability. This is an obvious concern to some members of Congress and NASA. "Is all, therefore, doom and gloom? Not necessarily. Just over a year ago, NASA chose two companies for its Commercial Orbital Transportation Systems (COTS) program ... The goal of COTS was for the two companies to build prototype space craft capable of delivering crews and cargo to the International Space Station. A second phase of the COTS program would consist of a competition for a contract to actually deliver crews and cargo to ISS after 2010 ... Private industry may well come to the rescue and preserve American access to space, at least until Orion becomes operational."

  Pleo Review - A Toy Robot Triumph?

'What most people will have a hard time understanding is that Ugobe's Pleo is one of the most sophisticated personal home entertainment robotic devices on the market today. It easily outshines robot toys from Wow Wee and Hasbro, though both companies offer robots that cost less than half of what Pleo does. Its nearest competitor, the Wow Wee Robopanda, is a good gift for young children, but it's not nearly as adorable, animated, or intelligent as Pleo. (Yes, it can stand up and crawl, but it doesn't look very good doing it.)'"

  Why Google Doesn't Need to Win the Bid to Win in January

The end goal of getting the government to put an open access stipulation on the spectrum, Google's end goal, is almost a given - in the author's opinion. From the article: 'Rather than actually winning the auction, Google's participation is likely intended to secure what it sees as the real reward: ensuring that whoever ends up owning the spectrum allows the open access of applications and devices. Indeed, as long as this goal is met, it's hard to see why Google would want to take on the costly task of building and running its own network. But given how much is at stake when it comes to the mobile market, Google's vigilance is shrewd, even if it never planned to own the spectrum.'"

  AT&T Wireless Network Is Open Too

'By its nature, GSM technology is open,' said Michael Coe, an AT&T spokesman. 'Customers could always use GSM phones not sold by AT&T on our network. We can't guarantee the performance of the device, of course.' AT&T will start to publicize that information through salespeople at AT&T stores, Ralph de la Vega, CEO of the company's wireless business, told USA Today."

  State of the Onion 11

  chromatic writes "Larry Wall's State of the Onion 11 address is now online. Every year, he describes the state of Perl and its community through metaphor and analogy. This year, Larry explored the history of scripting languages, from their dimly-lit beginnings to their glorious future. Along the way, he also describes several of the design principles invoked in the design of Perl 6. 'When I was a RSTS programmer on a PDP-11, I certainly treated BASIC as a scripting language, at least in terms of rapid prototyping and process control. I'm sure it warped my brain forever. Perl's statement modifiers are straight out of BASIC/PLUS. It even had some cute sigils on the ends of its variables to distinguish string and integer from floating point. But you could do extreme programming. In fact, I had a college buddy I did pair programming with. We took a compiler writing class together and studied all that fancy stuff from the dragon book.'"

A recent survey found that 26 percent of leisure travelers would pay $10 for Internet access on a two-to-four-hour flight and 45 percent would pay that amount for a flight longer than four hours. The airlines plans to turn their planes into the equivalent of a wireless hot spot once the aircraft reaches its cruising altitude but service will not be available on takeoff and landing. While the technology could allow travelers to make phone calls over the Internet, most carriers say they have no plans to allow voice communications."

They also feel that the authorities need the authority to seize any computers used for infringement and to send copyright cops abroad to help other countries enforce US laws. MPAA boss Dan Glickman praised the bill saying that, 'films left costs foreign and domestic distributors, retailers and others $18 billion a year,' though Ars points out that it allegedly costs the studios only $6 billion."

  Nielsen To Offer Web Copyright Protection System

According to Information Week, the system will provide 'a way to quickly discover unauthorized content on sites. To do that, the system would leverage Nielsen's existing watermark technology, which is used on more than 95% of TV programming distributed today. The watermarks are used by the meters installed in people's home to identify the programs they watch.'"

It worked. Of course a dead drive makes no noise. I've never met a BioWare game I didn't like (even liked Jade Empire , if you'll recall), and the much anticipated, hotly discussed Mass Effect is my game of the year ... which is not to say it's perfect. Gamers hoping for crystalline purity will be disappointed by, among other things, graphical pops, lengthy load times, and some occasionally stupid AI. It doesn't matter. Warts and all, this voyage to the edge of the galaxy and back is some of the best storytelling I've ever experienced in a game. It's like living a movie, a good one, where you decide the ending in a deeply meaningful way. Read on for my impressions of humanity's first steps onto the galactic stage.

  Robot-Run Warehouse Speeds Deliveries

  Ponca City, We Love You writes "The robot invasion may soon be coming to a warehouse near you. In a conventional warehouse, workers walk from shelf to shelf to fill orders, while in conveyor-based systems, boxes move past workers who pack them. A new warehouse design arranges rows and columns of freestanding shelves in a memory-chip-like grid serviced by robots. When a consumer submits an order, robots deliver the relevant shelving units to workers who pack the requested items in a box and ship them off allowing workers to fill orders two to three times faster than they could with conventional methods because the robots can work in parallel, allowing dozens of workers to fill dozens of orders simultaneously. The robotic system is also faster because the entire warehouse can adapt, in real time, to changes in demand by having the robots move shelves with popular items closer to the workers (pdf), where the shelves can be quickly retrieved while items that aren't selling are gradually moved farther away. Two giant warehouses have already been built for Staples and a third is being built for Walgreens where the software will also keep track of expiration dates to ensure that items that can go bad are sent out in the order that they're stocked."

  Folklore Review

  Using a soul to beat someone up sounds like sort of a strange hook for a game, but the quirky title Folklore from Game Republic offers exactly that. While it may appear to be sort of an RPG/action hybrid a more apt description would be a beat-em-up with a deep story, a brawler with some avatar advancement. Combining elements of such disparate titles as Silent Hill, Pokemon, and Final Fight, with a dash of PS3 motion-control (that actually works!) on top, the title's pitch stands out in a year already filled with unique offerings. The gameplay depth you experience in the first hour of play, unfortunately, is more or less the depth you'll experience throughout the game. Despite that, there's a lot to like here - especially for fans of things that go bump in the night. Read on for my impressions of this dark fantasy given form.

  Privacy Groups Mull 'Do Not Track' List for Internet

  Technical Writing Geek writes with a Reuters story about a collection of privacy groups looking to set up a 'Do Not Track' list online, similar to the 'Do Not Call' list meant to dissuade telemarketing. "Computer users should be notified when their Web surfing is tracked by online advertisers and Web publishers, argue the Consumer Federation of America, the World Privacy Forum and the Center for Democracy and Technology, among other groups in a coalition promoting the idea. Rather than burying privacy policies in fine print, companies should also disclose them more fully and provide easier ways to opt out, the groups said. The organizations submitted the proposals to the Federal Trade Commission, ahead of the consumer watchdog agency's workshop on Nov. 1-2 to study the increasing use of tracking technology to target online ads.

This probably presages a thoroughly overhauled Xserve product with greater capability for acting as a virtual machine server, too. 'Ben Rudolph, Director of Corporate Communications for Parallels, told me, "Enabling Leopard Server to run in a virtual machine may take some time, but we're working closely with Apple on it and will make it public as quickly as possible." Pat Lee, Product Manager at VMware, concurred, saying "We applaud Apple for the exciting licensing changes implemented in Leopard Server. Apple customers can now run Mac OS X Server, Windows, Linux and other x86 operating systems simultaneously on Apple hardware so we are excited about the possibilities this change presents." Although neither company committed to specific features or timetables, it appears as though we should be seeing virtualization products from both that will enable an Xserve to run multiple copies of Leopard Server in virtual machines.'"

In a summary judgement requested by the Defendant, Philip Smith was able to obtain a special sanction after the Plaintiff attorney put a 'notice of lien' (called lis pendens) on Smith's residence. The judge also reprimanded the Plaintiff attorney for abusive deposition and court procedure. The case set forth the following; 'It's not the format; it's the content and intention that make text journalism / reporting.'"

  Famous Criminal Opines that Technology Breeds Crime

Abagnale is a notrious criminal, whose exploits were portrayed in the movie 'Catch Me If You Can.' Abagnale claims: 'It would be 4,000 times easier to do today, what I did 40 years ago, and I probably wouldn't go to prison for it. Technology breeds crime — it always has, it always will ... I really think the more technology there is in the world, the more you have to instill character and ethics. You can build all the security systems in the world; you can build the most sophisticated technology, and all it takes is one weak link — someone who operates that technology — to bring it all down." This would seem to echo commentary in a New York Times article about the rise of Russian hackers in recent years.

  Scientist Are Working to 'Steer' Hurricanes

Both teams are using the technique of removing power and speed from strategic points in the hurricane, effectively refracting its path. The American team is approaching this by warming the areas of the tops of the hurricane clouds, either by dropping ash to absorb heat from the sun, or directly beaming microwaves on those areas from space. The Israeli team is taking the approach of cooling the bottom of the hurricane by releasing dust along its base."

  Storm Worm Being Reduced to a Squall

  Rumours of financial schemes surrounding the botnet aside, PC World has an article that should lower the blood pressure of some SysAdmins. The Storm Worm botnet is apparently shrinking. A researcher out of UC San Diego who has been tracking the network has published a report indicating it is now only 10% of its former size. "Some estimates have put Storm at 50 million computers, a number that would give its controllers access to more processing power than the world's most powerful supercomputer. But Enright said that the real story is significantly less terrifying. In July, for example, he said that Storm appeared to have infected about 1.5 million PCs, about 200,000 of which were accessible at any given time. Enright guessed that a total of about 15 million PCs have been infected by Storm in the nine months it has been around, although the vast majority of those have been cleaned up and are no longer part of the Storm network."

  Viacom Wants Industry Wide Copyright Filter

Mr. Dauman has the backing of Microsoft, Disney, and Universal. 'They reflect the fact that there ought to be a filtering system in place on the part of technology companies,' he noted. 'Most responsible companies have followed that path. What no one wants is a proprietary system that benefits one company. It is a big drain to a company like ours to have to deal with incompatible systems.' How would an industry standard impact freedom of speech and in particular censorship on the internet? How would it affect small, independent web sites?"

  Provider of Free Public Domain Music Shuts Down

  Mark Rogers writes "The International Music Score Library Project has provided access to copies of many musical scores that are in the public domain. It has just been shut down due to a cease-and-desist letter sent to the site operator by a European Union music publisher (Universal Edition). A majority of the scores recently available at IMSLP were in the public domain worldwide. Other scores were not in the public domain in the United States or the EU (where copyright extends for 70 years after the composer's death), but were legal in Canada (where the site is hosted) and many other countries. The site's maintainers clearly labeled the copyright status of such scores and warned users to follow their respective country's copyright law. Apparently this wasn't enough for Universal Edition, who found it necessary to protect the interests of their (long-dead) composers and shut down a site that has proved useful to many students, professors, and other musicians worldwide."

Yet, despite having only 47 million users today, Facebook's move to 64 bits will allow it to have more than 18 quintillion (18,446,744,074,000,000,000) user accounts. Of course, there are currently only about 6.5 billion people in the world. Is Facebook setting their sights beyond Earth or just trying to avoid what happened when Slashdot ran out of space for comment IDs last year. Perhaps they are planning to implement personas."

  Canada May Tax Legal Music Downloads

About two cents would be added to every song downloaded, with 1.5 cents being added to album downloads. Streaming services and subscriptions would also be taxed, to the tune of about 6% of the monthly fee. Most interesting - the tax would be retroactively applied to every transaction processed since 1996. 'The surcharge would help compensate artists for piracy, according to SOCAN's reasoning. The publishing group draws similarities between this and a 21-cent fee already applied to blank CDs in the country; the right to copy a song from an online store demands the same sort of levy applied to copying a retail CD, SOCAN argues. The tax may have a significant impact for online stores such as iTunes and Canada-based Puretracks, which will have to factor the amount both into future and past sales.'   FCC Looks To Offer Consumers More Wireless Choice

Along with the move to the auction system, the government is removing restrictions on pieces of the wireless spectrum, which will allow a freedom of choice not usually seen with wireless communication devices. 'In the past, when the F.C.C. auctioned spectrum for cellular service, it allowed the winners to determine the equipment and applications that would run on their networks. That created the current status quo, in which a vast majority of American consumers buy a handset from a wireless service provider. The open-access rules, which will apply to about one-third of the spectrum being sold at the auction, represent a significant departure from past practice. They require the winners to let consumers use any tested, safe and compatible device or application on its network. Entrepreneurs could sell handsets with capabilities that are unavailable -- or unavailable at affordable prices -- from current carriers.'"

  Space Elevator Teams Compete for NASA Prizes

  Hugh Pickens writes "The University of Saskatchewan's has the first place climb in the Second Annual Space Elevator Games being held this weekend at the Davis County Event Center in Salt Lake City. Teams are competing for $1,000,000 in NASA prize money. Although the idea of a space elevator has been around for decades, the space technologies needed to support it have yet to be created. The non-profit Spaceward Foundation has hosted an annual competition since 2005 to build a super-strong tether, or get a robot to climb a suspended ribbon. In the robot climber competition, teams have to get their device to hurtle up a 100-metre-long ribbon, suspended from a crane, at an average speed of two metres per second. The climber must be powered from the ground: strategies include reflecting sunlight from huge mirrors on the ground to solar panels on the climber; shining lasers from the ground up to similar panels on the robot; or firing microwaves up at the climber. Qualifying rounds have been taking place all week, and although high winds and rain have caused delays, four out of eight teams have made it into the finals. There are no outdoor climbs today because of bad weather but some of the tether competitions will happen indoors later this afternoon."

  Long-lived Mars Rovers to Keep on Roving

They've overcome amazing obstacles and they show no signs of shutting down any time soon. "'After more than three and a half years, Spirit and Opportunity are showing some signs of aging, but they are in good health and capable of conducting great science,' John Callas, rover project manager at NASA's Jet Propulsion Laboratory said in a statement. Since landing, the rovers have had to surmount a host of technical issues. Just a few weeks after landing, the Spirit rover had an out-of-memory problem that almost ended its mission before it began, but scientists were able to get the rover back into operation. In April 2004, both needed software updates to correct problems and improve their performance."

The Chicago Tribune reports that researchers can now make chromosomes to order. These artificial chromosomes are accepted as natural by the plants and passed through generations. As the Monsanto Company bought rights to use this mini-chromosome stacking technology in corn, cotton, soybeans, and canola, I guess we'll soon eat food made from permanently genetically modified organisms (PGMOs?)."

  Evidence of Steganography in Real Criminal Cases

Steganography is the stealth technique of hiding text or images within image files. Experts say that the wide availability of free point-and-click steganography tools is making the method of hiding illicit images and text easier to use. Not everyone is convinced; some security experts such as Bruce Schneier have dismissed steganography as too complex and conspicuous for the bad guys to bother using, especially for inside corporate espionage: 'It doesn't make sense that someone selling out the company can't just leave with a USB.'"

  New GPS Navigator Relies On 'Wisdom of the Crowds'

Information is passed back to Dash over a cellular data network, where it is shared with other users to let them know if there are slowdowns or traffic jams on the road ahead. The real benefit of the system isn't apparent until enough units are collecting data in a given area - so Dash distributed over 2,000 prototype units to test drivers in 25 large cities."

Since then, the vest has been adapted for the game industry, capable of delivering hits and shots exactly where you would feel them.   New England Patriots Obtain Online Ticket Reseller Names

  Billosaur writes "The New England Patriots sued on-line ticket re-seller StubHub (a subsidiary of eBay) to obtain the list of names of people who tried to buy or sell Patriots tickets using the service. StubHub lost an appeal in Massachusetts state court last week, and was compelled to hand over the list of 13,000 names. It is currently not clear what the Patriots organization intends to do with the names, but they have intimated that they may revoke the privileges of any season ticket holders on the list. The Center for Democracy and Technology, a Washington D.C.-based advocacy group, said the court order to turn over the names infringes on the privacy rights of Patriots fans. At issue is whether using the on-line service allows an end-run around team rules and Massachusetts state law, by allowing ticket holders to charge extreme mark-ups on their tickets."   Vonage Goes To Court III - The AT&T Suit

Vonage lost the previous two lawsuits, brought by Sprint-Nextel and Verizon. How much more money can Vonage afford to give away? How can Vonage educate a jury on prior art? 'It said in a filing to the U.S. Securities & Exchange Commission that AT&T is seeking injunctive relief, compensatory and treble damages and attorneys' fees in unspecified amounts. Vonage said the lawsuit was filed in the U.S. District Court of the Western District of Wisconsin on October 17.'"

This is the companion piece to the Clone Wars animated series, focusing on entirely new characters outside of the frame of the six movies. 'Lucas joked that the series would be about "the life of robots" but wouldn't let any details slip about the true premise. The "extended universe" of "Star Wars" has come to life already in Lucas-sanctioned novels, comics and games that chronicle the history of the Jedi and tell the tales of bit players in the films, such as the bounty hunters from "The Empire Strikes Back."'"

  Adobe Intends To Move All of Its Applications Online

  E1ven writes "Adobe has announced their intention to transition their entire suite of software to web-based applications This includes their popular offerings Photoshop, Illustrator and After Effects. '[Adobe Chief Executive Bruce] Chizen answered a question about whether a complete shift to Web delivery would take five or 10 years and he indicated it would be closer to a decade. Like many traditional software makers including Microsoft Corp., Adobe must fend off rivals delivering competing applications over the Web and it also needs to adopt a new business model after years of selling software in boxes. Chizen expects professional customers of products like Acrobat document-sharing or Photoshop for editing images would opt to pay for subscriptions versus facing a steady stream of advertising to use tools critical to their jobs.'"

  The Future of Trusted Linux Computing

According to author Matt Hartley, the idea of TC is quite reasonable; offering a locked-down environment offers several advantages to system administrators with possibly troublesome users. 'With the absence of proprietary code in the mix users will find themselves more inclined to trust their own administrators to make the best choices ... And so long as any controlled environment is left with checks and balances [like] the option for withdrawal should a school or business wish to opt out, then more power to those who want a closed off TC in an open source world."   Neuro-Reckoning May Reduce MMOG Time Lag

  Hugh Pickens writes "Time lag can cause some very strange behavior in massively multiplayer online games when players' actions onscreen become slow and jerky. New techniques are on the way to reduce the problem of lag time in MMOGs when a player's computer can't keep up with changes in a shared online world. Games like Quake use a technique called dead reckoning and while traditional dead-reckoning systems that assume that a game character will maintain the velocity and direction that it has at the moment an update is sent to all other participating computers; dead reckoning works best for movement and shooting and less well for erratic actions such as interacting with objects or with other players. Read the abstract of new technique called 'neuro-reckoning' that may improve the predictive process by installing a neural network in each player's computer to predict fast, jerky actions."

  Robotic Cannon Loses Control, Kills 9

  TJ_Phazerhacki writes "A new high tech weapon system demonstrated one of the prime concerns circling smarter and smarter methods of defense last week — an Oerlikon GDF-005 cannon went wildly out of control during live fire test exercises in South Africa, killing 9. Scarily enough, this is far from the first instance of a smart weapon 'turning' on its handlers. 'Electronics engineer and defence company CEO Richard Young says he can't believe the incident was purely a mechanical fault. He says his company, C2I2, in the mid 1990s, was involved in two air defence artillery upgrade programmes, dubbed Projects Catchy and Dart. During the shooting trials at Armscor's Alkantpan shooting range, "I personally saw a gun go out of control several times," Young says. "They made a temporary rig consisting of two steel poles on each side of the weapon, with a rope in between to keep the weapon from swinging. The weapon eventually knocked the pol[e]s down."' The biggest concern seems to be finding the glitches in the system instead of reconsidering automated arms altogether."

  Law Firm Claims Copyright on View of HTML Source

As reported on Tech Dirt, they've decided that viewing the HTML source of their site is a violation of copyright. From the site's EULA: 'We also own all of the code, including the HTML code, and all content. As you may know, you can view the HTML code with a standard browser. We do not permit you to view such code since we consider it to be our intellectual property protected by the copyright laws. You are therefore not authorized to do so.'"

  The Real Problem With the US Patent System

They have no effective quality standards, only production standards, so many applications get only cursory review just so the PE can keep up the grueling pace. The USPTO is the only government agency that can and does lay you off if your productivity drops below 85% of the standard for your civil service grade. A Primary PE has to process 5 new and 5 old applications every 2 weeks (that's 8 hours each, folks). The best part — that 28-box application mentioned in the article? — it gets the PE the same credit as the smallest application. How many of those 28 boxes do you think even got opened?"

  Viacom Puts the Daily Show Archive Online

The content is available from the official Daily Show site, and features clip rating, tags, and numerous community features. The whole thing is support by relatively unobtrusive contextual ads. 'Viacom's decision to post its entire archive--while fighting YouTube in the courts--sets the scene for a battle between the established media players and their high profile entertainment brands against the user generated content sites, most notable YouTube. Also watching closely the Viacom experiment will be the telco IPTV industry which has seen the market place change rapidly as the quality of online video continues to improve, with at least one platform/site, Vimeo, already offering 1280X720 HD quality direct from the browser.'"

  Storm Worm Botnet Partitions May Be Up For Sale

  Bowling for cents writes "There is evidence that the massive Storm Worm botnet is being broken up into smaller networks, and a ZDNet post thinks that's a surefire sign that the CPU power is up for sale to spammers and denial-of-service attackers. The latest variants of Storm are now using a 40-byte key to encrypt their Overnet/eDonkey peer-to-peer traffic, meaning that each node will only be able to communicate with nodes that use the same key. This effectively allows the Storm author to segment the Storm botnet into smaller networks. This could be a precursor to selling Storm to other spammers, as an end-to-end spam botnet system, complete with fast-flux DNS and hosting capabilities."

  Phone Companies Refuse to Give Congress Data on Spy Program

The panel is making an inquiry into Bush administration tactics in the years since 2001, but has been stymied by the administration's claim that releasing that information would be illegal. As a result Verizon, AT&T, and Qwest have declined to answer the panel's queries. '"Our company essentially finds itself caught in the middle of an oversight dispute between the Congress and the executive relating to government surveillance activities," AT&T Inc. General Counsel Wayne Watts said in a letter to the House Energy and Commerce Committee that was released today by the panel.'"

  Microsoft Working On Health Information 'Vault' System

The plan is to offer personal health care records online via a system called HealthVault. Numerous big names in the medical field have signed up for the service, including the 'American Heart Association, Johnson & Johnson LifeScan, NewYork-Presbyterian Hospital, the Mayo Clinic and MedStar Health'. The ultimate purpose of the service is to provide an online accessible but highly secure service to patients and medical facilities: "The personal information, Microsoft said, will be stored in a secure, encrypted database. Its privacy controls are set entirely by the individual, including what information goes in and who gets to see it. The HealthVault searches are conducted anonymously and will not be linked to any personal information in a HealthVault personal health record. Microsoft does not expect most individuals to type in much of their own health information into the Web-based record. Instead, the company hopes that individuals will give doctors, clinics and hospitals permission to directly send into their HealthVault record information like medicines prescribed or, say, test results showing blood pressure and cholesterol levels. "

  Scientists Develop Cyborg Interface Algorithm

Their approach allows a paralyzed individual to manipulate a prosthetic - but that's not the important advance. 'Other scientists have already done that, and built prototypes for neural brain-to-machine devices that can work for animals or humans. But each team has taken a different approach to the problem, such as developing algorithms for measuring activity in a specific brain region, or measuring them through EEGs vs. optical imaging. MIT said that it has developed a unified algorithm that can work within the parameters of these different approaches. Lakshminarayan "Ram" Srinivasan, lead author of a paper on the subject, said MIT's new graphical models are applicable no matter what measurement technique is used. "We don't need to reinvent a new paradigm for each modality or brain region," he said in a statement.'"

  Undocumented Bypass in PGP Whole Disk Encryption

  A non-mouse Coward writes "PGP Corporation's widely adopted Whole Disk Encryption product apparently has an encryption bypass feature that allows an encrypted drive to be accessed without the boot-up passphrase challenge dialog, leaving data in a vulnerable state if the drive is stolen when the bypass feature is enabled. The feature is also apparently not in the documentation that ships with the PGP product, nor the publicly available documentation on their website, but only mentioned briefly in the customer knowledge base. Jon Callas, CTO and CSO of PGP Corp., responded that this feature was required by unnamed customers and that competing products have similar functionality."

This piece looks at new concerns from old hands at networking, with comments from folks like Larry Roberts and Len Bosack. 'Mr. Roberts's concern over the Internet's infrastructure stretches back years. Even while at ARPAnet, he says he was unsure how long the technology could work, especially since the system didn't ensure that information packets would arrive at their destination. His fears crystallized in the late 1990s when he saw companies begin to use the Internet to make phone calls and consumers begin to dabble in online video.'"

As the popularity of flash media continues to explode, hackers may be targeting embedded video players and more traditional video downloads with worms and virii. 'One worm discovered in November 2006 launches a corrupt Web site without prompting after a user opens a media file in a player. Another program silently installs spyware when a video file is opened. Attackers have also tried to spread fake video links via postings on YouTube ... Another soft spot involves social networking sites, blogs and wikis. These community-focused sites, which are driving the next generation of Web applications, are also becoming one of the juiciest targets for malicious hackers.'"

  HD Recorder Can Use Standard DVDs

The new device is expected to be a boon for the backer of the Blu-ray format; Blu-ray uses discs several times more expensive than standard DVD media. While the DVD discs won't have the capacity of a Blu-ray disc, the content will be of similar visual quality. 'The company said it will start selling three models of new DVD recorders capable of recording full HD programs on conventional DVD discs on November 1.   EBay Admits To Bad Call On Skype

  MaineCoasts writes "The Times online reports that two years after buying Skype for 2.6 billion, Ebay yesterday warned shareholders that they may have made a mistake. In essence, they vastly overpaid for the company. ZDNet offers analysis of the announcement: 'Clearly, the current business model is not enough to satisfy eBay in light of how much the company spent on Skype. And the reason is simple. Even though Skype has done a very good job of getting users to download its software client, most people who use the service do so to make free Skype-to-Skype phone calls. The only way that Skype makes money from its subscribers is when people use its Skype-In or Skype-Out services. Skype-In allows users to pay to rent a phone number, which people on regular phones can call. Skype-Out allows users to call traditional phones or cell phones for a fee.'"

  AT&T Welcomes Programmers for All Phones Except the iPhone

An article in the New York Times, though, points out that there are hundreds of phones out there working on open platforms that don't seem to be causing network interference. AT&T and Palm, in fact, welcome experimentation on their platforms. In AT&T's case ... on every phone but the iPhone. 'Hackers who have explored the workings of the phone say it uses the frameworks and structures that Apple uses on its other platforms to enable development; it just hasn't been documented. So if Apple is going to allow applications later, is there any reason -- other than vindictiveness or obsessive interest in control -- that it would want to cut off those developed by the pioneers who figured things out ahead of the official launch?'"

The law only applies to data on UK shores, and doesn't cover information transmitted via UK servers across the internet. The Home Office has steadfastly proclaimed that the law is aimed at catching terrorists, pedophiles, and hardened criminals--all parties which the UK government contends are rather adept at using encryption to cover up their activities.'"

  '30 Year Laptop Battery' is Unscientific Myth

Betavoltaic power cells are constructed from semiconductors and use radioisotopes as the energy source..." Except, not so much. ZDNet's Mixed Signals blog with Rupert Goodwins explains why (as always) if it sounds too good to be true, it probably is: "The sort of atomic structures that generate power when bombarded with high energy electrons are the sort that tend to fall apart when bombarded with high energy electrons. While solar cells have the same problem, it's to a much lesser extent. There's a lot of research into making materials that don't suffer so much, but it remains a serious issue ... while it's true that a tritium-powered battery will eventually turn into an inert, safe lump of nothing much, and while it's also true that a modest amount of shielding will keep the radioactivity within the the battery the while, there's the small problem that if you break the battery during its life the nasties come out."

  Carnegie Mellon CAPTCHA Digitization Project Now Underway

  tomandlu writes "The BBC is reporting that Carnegie Mellon University has found a novel use for CAPTCHAs — deciphering old texts. We've discussed this project before, but it was prior to it getting off the ground. Users Entering text acts as a sort of distributed computing project. Basically, the CAPTCHA is made up of two words — one of which is known to Carnegie, and one of which isn't. If the user correctly deciphers the known word, then the unknown word is assumed to be correct. Well, almost. Two different users must give the same answer to the same unknown CAPTCHA before it is taken off the list. 'Using the reCAPTCHA system von Ahn's team is digitizing documents and manuscripts as fast as the Internet Archive can supply them, and the good news for book lovers (and bad news for spammers) is that the supply of reCAPTCHAs is not likely to dry up any time soon.'"

  Halo 3 Review

  From a certain point of view, Halo 3 is without a doubt the biggest game of the year. The combination of fan anticipation, marketing, and the skill of Bungie's design combine to create a game that's larger than life; if gaming has a blockbuster franchise to match the movie industry's punch, it's the tale of Master Chief. The importance of the Halo franchise to gaming is a very big issue, though, and one worth it's own article. Having played through the game, there's really only one question I'm here to answer today. Does it meet expectations? In a word: yes. It's not the best game ever made, and it may not even be the best game this year. Will it make the fans happy, and deservedly sell thousands of Xbox 360s? Very much yes. Read on for my impressions of Bungie's years-in-the-making epic, Halo 3.

  Jack Thompson Sets His Sights On Halo 3

  GamePolitics is reporting that anti-game advocate Jack Thompson is seeking to have Halo 3 declared a nuisance to the public in Florida. He tried the same stunt with Bully, and failed then too. "As with Bully, Thompson clearly hopes the court will grant him a hearing. Although after last year's well-publicized Bully performance, which earned Thompson a Bar complaint from presiding Judge Ronald Friedman, that seems unlikely. More troubling by far are the long term implications of this action. Thompson apparently feels emboldened to invoke Florida's public nuisance law against any video game he desires to target. That is the essence of censorship and the video game industry cannot allow it to continue on any number of grounds - legal, moral or creative."

  New York Times Ends Its Paid Subscription Service

  Mike writes "The New York Times has announced that it will end its paid Internet service in favor of making most of its Web site available for free. The hope is that this move will attract more readers and higher advertising revenue. 'The longer-term problem for publishers like the Times is that they must find ways to present content online rather than just transferring stories and pictures from the newspaper. Most U.S. news Web sites offer their contents for free, supporting themselves by selling advertising. One exception is The Wall Street Journal which runs a subscription-based Web site. TimesSelect generated about $10 million in revenue a year. Schiller declined to project how much higher the online growth rate would be without charging visitors.'"

  Astronomers Find Stars 7 Billion Light Years Away

  StArSkY writes "The Age has an article about an international team of astronomers that has discovered 14 galaxies, opening up a new era of 'galaxy hunting'. Using an infrared instrument in Chile (the European Southern Observatory's Very Large Telescope ) — the researchers have been able to look through the glare of 20 Quasar's to identify previously obscured galaxies. 'Light from the newly found galaxies comes from the time the universe was about 6 billion years old, less than half its current age. By studying the light, the researchers have determined they are starburst galaxies that form lots of new stars -- the equivalent of 20 suns a year. Dr Murphy, who began working on the project while a research fellow at the University of Cambridge, described the results as a great leap forward. The findings have been accepted for publication in The Astrophysical Journal. '"

  AMD Announces Triple-Core Phenom Processors

  MojoKid writes "AMD has officially announced their triple-core Phenom multi-core processor offering, suggesting a triple-threat of processors, from dual-cores to triple-cores and native quad-cores coming to market this year. While the term symmetric multi-processing (or SMP) suggests a balanced approach of multiple cores in an even number of engines working together on a single workload, AMD offers that an odd number of processors can slice at that workload just as efficiently. Time will tell how this architecture will scale amongst various multi-threaded applications and real-world usage models. AMD is definitely moving to make use of these quad-cores that don't quite make the cut by testing them fully as triple-cores and realizing some revenue, rather than throwing them away."

  How to Stop Commerial Use of Copyleft Materials?

  An anonymous reader writes "The Guild Wiki, an extremely popular fan-made wiki for documenting the Masssively Multiplayer game Guild Wars, was originally supported by donations, then later advertisements — supposedly just enough to break even. Just the past week, the owner of the domain name surprised this wiki community by revealing that he had sold the domain name, the database, and his services to Wikia, a commercial entity that intends to profit from Guild Wiki's content. The catch? Much of Guild Wiki's content falls under Creative Commons by-nc-sa license, which denies the commercial use of licensed material. Arena.net created their own community run wiki to serve as the in-game help system, because they didn't think they could use the material on Guild Wiki commercially. If Wikia continues to serve ads over Guild Wiki's content, how can the thousands of contributors to the site stop them without going to the expense/trouble of hiring attorneys (or the crude path of mass vandalism)? If it turns out the site owner has been making a profit all along from ads, what's the remedy?"

  CRIA Admits P2P Downloading Legal in Canada

  An anonymous reader writes "Michael Geist is reporting that the Canadian Recording Industry Association — the Canadian equivalent of the RIAA — this week filed documents in Canadian court that seeks to kill the expansion of the levy on blank media to iPods since it fears that the system now legalizes peer-to-peer downloading of music in Canada.   Virtually Non-Stick Gum Created

In testing the gum was removed by weather while the competitor's gum was not removed 4 out of 5 times. The BBC reports: 'The company now needs to get its polymer accepted as a food product by passing EU health and safety tests. It can then go on sale. Professor Cosgrove says he is hopeful that the gum will pass them, and says the product could be on the market as early as next year, either as a Revolymer product or through a partnership with one of the major chewing gum manufacturers.'"

  OLPC Cost Rises To $188 Per Laptop

  Arathon writes "The amazing '$100 laptop' designed by the 'One Laptop Per Child' program isn't going to make it out the door for that price. CNN reports that the laptops are now expected to cost $188 apiece when they come out later this fall. This is expected to make the program's appeal potentially much smaller, since the developers were relying on the mind-bogglingly low-price to hook governments into the concept of buying laptops for their people. OLPC's spokesman guarantees that the price won't rise further, to 'above $190'. The price differential is being blamed on raw materials costs and currency fluctuation. Is this the end of the OLPC's newsworthiness, or should we continue to hope that it will make the difference that so many have said it will?"

  Google Quietly Closes AdSense API to Small Sites

  NewsCloud writes "Google has raised the required minimum traffic limit for publishers who wish to use its AdSense API to 100,000 page views per day. The AdSense API was introduced in March as a way for sites with user generated content to share advertising revenue with their members. Says Google, "This policy change will probably result in fewer developers going live and give us a chance to enhance our support resources and processes to more easily support a greater number of developers in the future...we hope to be able to lower it in the future as we become more efficient at supporting our developers!" Meanwhile, some publishers report waiting a month for their API usage to be approved. I take Google at its word for now but worry that small developers could be increasingly squeezed out of the mashup space if this were to become a trend."

  Company Demos Personal Aircraft, Future Jetpack

  coondoggie writes "Earlier this week researchers with the company ESG Elektroniksystem in Germany demonstrated a form of 'strap-on jet wing' that lets a user truly fly through the air. The system, called Gryphon, consists of a six-foot wing and hand-held rotary controls for the rudder. The pilot has several different instruments available to him, including onboard oxygen and helmet that features a heads-up display. 'Researchers say the final version of the flying wing will contain an electronic system that will take care of some of the steering for the pilot which today can be a little tricky, researchers say. The company also plans to add small jets to the wing making it a true jetpack in the future.'"

This includes much of the information applicable to all operating systems. He prefaces his comments noting that the details are entirely device specific, then dives right into a fascinating and somewhat disturbing path tracing data from the drive, through the cable, into the bus, main memory and CPU cache. He also discusses the transfer of data via TCP and cautions, 'unfortunately lots of high performance people use checksum offload which removes much of the end to end protection and leads to problems with iffy cards and the like. This is well studied and known to be very problematic but in the market speed sells not correctness.'"

  Ameritrade Security Audit Finds Privacy-Busting Back Door

Today TD Ameritrade released details of their investigation into the matter (along with a video message from the CEO and special FAQ). It seems some 'unauthorized code' had exposed client email addresses and possibly other sensitive information from an internal database. 'TD Ameritrade tracked down the break-in while doing an internal investigation into stock-related spam. The company called in forensic investigators and they discovered "unauthorized code" in their system that provided access for the hacker or hackers. According to the advisory, the code has been eliminated from the system. Moglia, speaking in an online video-taped message to customers, said he is "confidant" that they have figured out how the information was taken.'"

  SCO Files for Chapter 11 Bankruptcy

This move just so happens to fall on the eve of SCO's trial with Novell. One would think that their prior boasts were mostly bluster, that they believe they have almost no chance of prevailing at trial, and that they're now desperate to protect their executives from SCO's creditors while seeking yet another delay. From the release: 'The SCO Group intends to maintain all normal business operations throughout the bankruptcy proceedings. Subject to court approval, SCO and its subsidiaries will use the cash flow from their consolidated operations to meet their capital needs during the reorganization process. "We want to assure our customers and partners that they can continue to rely on SCO products, support and services for their business critical operations," said Darl McBride, President and CEO, The SCO Group. "Chapter 11 reorganization provides the Company with an opportunity to protect its assets during this time while focusing on building our future plans."'"

  Apple Cuts Off Linux iPod Users

  Will Fisher writes "New iPods will no longer be able to work with Linux. iTunes now writes some kind of hash (SHA1, md5?) to the iPod database which new iPods check against. If this check fails then the iPod reports that it contains 0 songs. This appears to be protection against 3rd party applications writing out their own databases. We haven't found out how to generate our own valid hashes (but we do know the hash includes the database itself, and possibly the iPod serial number), and are looking for help."

  How To Configure Real PC Parental Controls?

  Orange Crush writes "As the resident computer geek in an office full of accountants, my boss recently asked me how she could reasonably keep her teenage son from using the family computer to 'access inappropriate sites.' I of course responded 'Give up now. There's nothing in this world that can keep a determined teenager from acquiring porn.' Sadly, she was dissatisfied with this answer. I mentioned that there was in fact software available for this purpose, but that all of it was trivially easy to bypass for a clever young mind. I really can't think of another answer. She could password protect the BIOS to prevent booting a different OS, but that's easily defeated with a screwdriver at most. The only solutions I can think of involve upstream firewalls/proxies/etc to which I gleefully redirected her to her ISPs tech support number. As much as I disagree with her reasoning — and ignoring the obvious 'go to a friend's house' loophole — is there really any other way (on a home budget) to netnanny a household computer?"

  Lindor Attacks Record Company Copyright-Pooling

  NewYorkCountryLawyer writes "Back in March, 2006, Marie Lindor called the record companies suing her a collusive cartel, and their joint agreement to pool their copyrights "copyright misuse" (pdf). A year and a half later, the RIAA apparently got nervous about that allegation and made a motion to strike the allegations. Ms. Lindor has struck back, pointing out to the Judge not only that the RIAA's arguments had no legal basis, but also that its brief was completely silent as to any justification for the record companies' copyright-pooling agreement. Such a justification would be necessary for it to pass muster under 'rule of reason' analysis mandated by the US Supreme Court. Ms. Lindor, a home health worker who has never even used a computer, let alone infringed anyone's copyrights with a p2p file sharing program, is the same defendant who exposed, with a little help from her friends, some of the weaknesses in the RIAA's expert testimony. She also obtained a ruling that the RIAA's $750-per-song file damages theory might be a wee bit unconstitutional."

  RIAA Complaint Dismissed as "Boilerplate"

While the legal community has been looking towards a Manhattan case (Elektra v. Barker) for guidance, the decision instead came from Senior District Court Judge Rudi M. Brewster of the US District Court for the Southern District of California. The decision handed down denied a default judgment (i.e. the defendant had not even appeared in the action). Judge Brewster not only denied the default judgment motion but dismissed the complaint for failure to state a claim. Echoing the words of Judge Karas at the oral argument in Barker , Judge Brewster held (pdf) that 'Plaintiff here must present at least some facts to show the plausibility of their allegations of copyright infringement against the Defendant. However, other than the bare conclusory statement that on "information and belief" Defendant has downloaded, distributed and/or made available for distribution to the public copyrighted works, Plaintiffs have presented no facts that would indicate that this allegation is anything more than speculation.'"

  Verizon Sues FCC over 700MHz Open Access Rules

The company has filed a lawsuit in the Court of Appeals for the DC Circuit, urging the court to overturn the rules. 'In its petition for review, Verizon argues that the FCC exceeded its authority in mandating the two open access conditions, accusing the Commission of being "arbitrary" and "capricious," and saying that the rules are "unsupported by substantial evidence and otherwise contrary to law." Google is critical of Verizon's lawsuit: 'It's regrettable that Verizon has decided to use the court system to try to prevent consumers from having any choice of innovative services. Once again, it is American consumers who lose from these tactics.'"

Two days ago YouTube reported to Knight that his clip was back up and that his account wouldn't be punished. What happened? Knight filed a DMCA counter-notification claim with YouTube: something that happens 'all too rarely' according to Fred von Lohmann at the Electronic Frontier Foundation. From the article: 'Almost no one ever files a counter notice. That's the biggest problem we've encountered [with DMCA claims on sites like YouTube]. Most people have no idea that right exists.'"

  Compiz Gets Thumbs-Up for Gutsy Gibbon

The decision was made despite the fact that Compiz still has some significant issues relating to drivers and Xorg. 'For instance, there are some problems — like accelerated video playback issues with Intel drivers — that can only be resolved by using the EXA accelerated rendering framework which is still not ready yet. When asked why Intel isn't addressing the driver issue, technical board member Mathew Garrett explained that "Intel are working on the basis that composited desktops won't be ready for rolling out until EXA is stable enough anyway, so it's not a concern [for them].' In the end, all but one member voted to include Compiz in Gutsy."

  BioShock Review

  BioShock, the moody drama-driven FPS for the Xbox 360 and PC, was released last month to rave reviews from the major gaming news sites. Since then the internet has been ablaze with outcry about the game's high rating scores. It's hard to understand why. The work of Ken Levine and Irrational Games on the spiritual successor to System Shock 2 is sublime. It's incredibly atmospheric, the game's story is well written and compellingly told, and the first-person shooter gameplay is a respectable, tightly crafted experience. It's a really, really good game. I'll tell you now: it's a 5/5. So why all the angst? Why the backlash? Read on for my review of BioShock, and a few comments on the dangers of 'merely' being a good game.

  Swedish Company Trials Peer-to-Peer Cellphones

Phones are used to route calls onto other phones, constructing mesh networks of 'up to 20km'. The BBC reports on the natural tendency of the big telecoms providers to want to squash this. I can see other problems though. The advantages in an environment with sparse cell coverage are obvious, but network effects mean that the number of connections in a heavily populated mesh grow exponentially. What happens to your battery life when your phone becomes a node? And while the company is optimistic that they have a viable technology model from IP licensing, the demand for devices supporting this is going to be proportional to the number of devices that it can connect you to."

If the website designer has to pay for bits each time you view their website without viewing their banner ads, are you engaged in theft? Is this right? "

'When the specification was donated to the Linux Foundation, Oracle, Sun, and SAP committed to help with future development. Mozilla is committed to incorporating it into its Firefox browser, and vendors GW Micro and Freedom Scientific will also use it in their own screen reader products.   Eavesdropping Helpful Against Terrorist Plot

The intercepted phone calls and emails revealed a connection between the plotters and a breakaway cell of the terrorist group Islamic Jihad Union. What does this mean for the future of privacy in personal communications? From the article: '[Director of national intelligence Mike McConnell's] remarks also represent part of intensifying effort by Bush administration officials to make permanent a law that is scheduled to expire in about five months. Without the law, the Foreign Intelligence Surveillance Act, Mr. McConnell said the nation would lose "50 percent of our ability to track, understand and know about these terrorists, what they're doing to train, what they're doing to recruit and what they're doing to try to get into this country.'"

  Will GPLv3 Drive Users from Linux to FreeBSD?

It's based on issues raised in the August FreeBSD Foundation Newsletter. That publication features a letter by the vice president of the FreeBSD Foundation, Justin Gibbs, arguing that the GPLv3 restricts the rights of commercial users of open source software, and is just the FSF's first step in changing the GPL in ways that authors of GPL software may not have intended. He suggests that commercial users should seriously consider BSD-licensed software as an alternative if they want to be able to safely ship products in the future. This is especially in light of requirements from the FCC that software running on devices (such as software-defined radios) be end-user replaceable. Gibbs states that the FreeBSD Foundation will provide an alternative to GPLv3'd software, especially in light of Stallman's statement that further GPL revisions are due in the near future. Is this likely to cause discontent among Linux users, or will they mostly ignore it?"

The simple, low-cost technique results in the self-formation of periodic lines, or gratings, separated by as little as 60nm, or less than one ten-thousandth of a millimetre. From the article: 'The new 'fracture-induced structuring' process starts when a thin polymer film is painted onto a rigid plate, such as a silicon wafer. A second plate is then placed on top, creating a polymer 'sandwich' that is heated to ensure adhesion. Finally, the two plates are prised apart. As the film fractures, it automatically breaks into two complementary sets of nanoscale gratings, one on each plate. The distance between the lines, called the period, is four times the film thickness.'"

  Apple May Introduce New iPod on Wednesday

Reporters from across Europe have been asked to view a broadcast presentation by Steve Jobs at the BBC headquarters. '[An analyst with Goldman Sachs] believes that a new line of iPods will boost demand for the gadget from Goldman's present forecast of about 19.8 million units for Apple's key first quarter - the reporting period that covers Christmas. However, that still suggests that demand for iPods will be flat, at best, compared with the same period last year, when Apple sold about 21 million devices.'"

It comes powered by any of a variety of AMD processors. These range from the 1.60 GHz AMD Sempron 3000+ processor to the speedy 2.8 GHz AMD Athlon 64 X2 Dual-Core 5600+ processor. The dx2250 can hold up to 2GB of RAM. For storage, it maxes out with a 250 GB hard drive. It comes with a variety of optical drive options, ranging from ordinary CDs to a DVD+/-RW LightScribe, Double Layer/Dual Format drive. At this time, it is not clear exactly what options HP will be offering with the RHEL-based system. Previously, HP had offered this desktop computer with a choice of Vista Business, XP, and FreeDOS.   Australian ISPs Reject Calls To Police Their Users

Australian ISPs, though, have soundly rejected calls from AFACT to slow down or terminate user accounts that AFACT has determined are being used to distribute copyrighted works. Telstra (one of the larger ISPs in question) had this to say: 'We do not believe it is up to the ISPs to be judge, jury and executioner in relation to the issue when the content owners have any number of legal avenues to pursue infringements.'"

  theodp writes "The Seattle P-I's Todd Bishop reports that Microsoft has settled its 8-year-old web browser plug-in patent dispute with Eolas. The spat begat the click-to-activate Web after Microsoft was slapped with a $500+ million patent infringement judgement. Neither Eolas nor Microsoft will be disclosing terms of the deal, although Eolas told investors to expect a dividend (PDF). Microsoft didn't say whether or how the settlement would affect its approach to the underlying technology in IE or other programs. Just last month, the USPTO issued a non-final rejection of the patent's claims, citing the work of Pei-Yuan Wei as prior art."

  One Species' Genome Discovered Inside Another's

  slyyy writes "The Universtiy of Rochester has discovered the complete genome of a bacterial parasite inside the genome of the host species. This opens the possibility of exchanging DNA between unrelated species and changing our understanding of the evolutionary process. From the article: 'Before this study, geneticists knew of examples where genes from a parasite had crossed into the host, but such an event was considered a rare anomaly except in very simple organisms. Bacterial DNA is very conspicuous in its structure, so if scientists sequencing a nematode genome, for example, come across bacterial DNA, they would likely discard it, reasonably assuming that it was merely contamination--perhaps a bit of bacteria in the gut of the animal, or on its skin. But those genes may not be contamination. They may very well be in the host's own genome. This is exactly what happened with the original sequencing of the genome of the anannassae fruitfly--the huge Wolbachia insert was discarded from the final assembly, despite the fact that it is part of the fly's genome.'"

  Sweden's Vote on OOXML Invalidated

  Groklaw Reader writes "Just days after Microsoft's attempt to buy the Swedish vote on OOXML came to light, SIS declared its own vote invalid. The post at Groklaw references a ComputerWorld article with revelations from Microsoft: 'Microsoft Corp. admitted Wednesday that an employee at its Swedish subsidiary offered monetary compensation to partners for voting in favor of the Office Open XML document format's approval as an ISO standard. Microsoft said the offer, when discovered, was quickly retracted and that its Sweden managers voluntarily notified the SIS, the national standards body. "We had a situation where an employee sent a communication via e-mail that was inconsistent with our corporate policy," said Tom Robertson, general manager for interoperability and standards at Microsoft. "That communication had no impact on the final vote." ...'"
